RESOLUTION NO. 1578
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY AMENDING COOPERATIVE AGREEMENT
#43-227205 TO PROVIDE FOR THE BID ITEM MOBILIZATION AND MODIFYING RESOLUTION
NO. 1457 FOR THE RELOCATION AND PLACEMENT OF SANITARY SEWER AND WATER LINES IN
CONNECTION WITH THE GILROY FREEWAY BYPASS, ROUTE 04-SCI-101, 1.4 MILES SWTH
OF THOMAS ROAD TO 0.5 MILE NORTH OF LEAVESLEY ROAD, DISTRICT AGREEMENT #4-0125-C.
WHEREAS, the STATE OF CALIFORNIA and the CITY OF GILROY hereto have
entered into an Agreement (Document File #43-227205), executed on April 6, 1970,
providing for relocation and placement of sanitary sewer and water lines in
connection with STATE's proposed project on State Route 101 between 1.4 mile
south of Thomas Road near Gilroy and 0.5 mile north of Leavesley Road; and
WHEREAS, Section 14253.5 and 14403 have recently been added to the
Government Code relating to the State Contract Act, Section 14253.5 providing
a schedule of partial payments and final payment for a lump sum bid item for
Mobilization; and
WHEREAS, the original intent of aforesaid Agreement was that each
should pay their fair share and at the time of execution of aforesaid Agreement,
neither party anticipated legislation that would provide for this new bid item;
and
WHEREAS, CITY and STATE mutually desire to modify aforesaid Agreement
to provide for the sharing of the cost of said new contract bid item for Mobili-
za t i on .
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Gilroy
that it hereby amends Cooperative Agreement #43-227205 to provide for the
sharing of the cost of said new contract bid item for mobilization and authorizes
the Mayor to execute the amended agreement on behalf of the City of Gilroy.
BE IT ALSO RESOLVED that Resolution No. 1457 adopted April 6, 1970 is
hereby modified to reflect these changes.
