RESO LUT ION NO. 1 592
A RESOLUTION OF THE ClTY OF GlLROY AMENDlNG SECTlON IV, D.
PARAGRAPH 5 TO BETTER DEFINE PROCEDURES FOR THE PERSONNEL
COMMISSION AFTER A HEARlNG FOR AN APPEALED DISMISSAL.
WHEREAS it has been determined by the City Attorney that the existing procedures
are not adequate for the Personnel Commission to properly advise the Council of its
action upon culmination of a hearing as set forth in Section IV, D. of the Personnel
Rules and Regulations and,
WHEREAS the Personnel Commission did review and endorse said recommendation at
their regular meeting of August 26, 1971 and,
WHEREAS it is the desire of the City Counci 1 to maintain proper Personnel Rules
and Regulations to better perform the personnel procedureso
NOW, THEREFORE, BE IT RESOLVED that Section lV, D. paragraph 5 of the Personnel
Rules and Regulations be amended to read:
Written findings and conclusions together with such recommendations and
decision as it shall deem proper shall be transmitted within ten days
after the close of the hearing by the Personnel Commission to the app-
ointing authority and the employee at his last known addresso Either the
appointing authority or the employee shall have five days from receipt
of the decision of the Personnel Commission to file an appeal with the
City Clerk.
At its first regular meeting thereafter, the City Council shall, in closed
personnel session, review the record, findings conclusions and recommend-
ations of the Personnel Commission, and may, at it option, request such
further evidence as the Council deems necessaryo The Council shall within
21 days after commencing its review of the Personnel Commission proceedings,
make a final decision adopting, modifying or reversing the conclusions of
the Personnel Commission and may make and substitute such other final de-
cision or determination as it may deem just and proper.

GOODRICH.
