RESOLUTION NOo 1594
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
DENYING THE APPEAL FROM RESOLUTION NO. 546 OF
THE PLANNING COMMISSION GRANTING A CONDITIONAL
USE PERMIT TO JAMES ALLAN AND SONS.
WHEREAS, NICK J. LIVAK, on behalf of the GILROY CITIZENS
FOR BETTER COMMUNITY PLANNING has filed an appeal in due form
from Resolution No. 546 of the Planning Commission of the City
of Gilroy granting a conditional use permit to erect and operate
an abattoir and meat processing plant located north of Bolsa Road
and East of Monterey Highway in the City of Gilroy, and notice
of the hearing of said appeal has been given in the manner required
by law and the Zoning Ordinance of the City of Gilroy; and
WHEREAS, the said hearing on the appeal has been held on
September 20, 1971, at 8:00 p.m. in the Council Chambers in
the City Hall at 7390 Rosanna Street, Gilroy, California, and
evidence was submitted upon the said application and appeal from
the findings of the Planning Commission, the City Council finds:
(1) That the proposed use is properly located in relation
to the General Plan and to the community as a whole and to other
land used and to transportation and service facilities in the
vicinity as determined by the Planning Commission from substantial
evidence; and
(2) That the proposed use, if it complies with all conditions
upon which approval is made contingent, will not adversely affect
other property in the vicinity or cause damage, hazard or nuisance
to persons or property as determined by the Planning Commission
from substantial evidence; and
WHEREAS, the Planning Commission did not err in granting
the use permit based on evidence presented at the Planning
Commission, the appeal shall be and the same is hereby denied.
PASSED AND ADOPTED this 20th day of September, 1971, by the
