RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
DENYING WITH MODIFICATIONS THE APPLICATION OF
SOUTH COUNTY YOUTH CENTER FOR A CONDITIONAL USE
PERMIT TO OPERATE A YOUTH CENTER AT 7484 MONTEREY
STREET IN THE CITY OF GILROY ON APPEAL FROM
RESOLUTION NO. 558 OF THE PLANNING COMMISSION
DENYING SAMEo
WHEREAS, SOUTH COUNTY YOUTH CENTER has filed an appeal in
due form from Resolution No. 558 of the Planning Commission of
the City of Gilroy denying a conditional use permit to operate
a youth center in a C-2 (General Commercial) zone at 7484
Monterey Street, and notice of the hearing of said appeal has
been given in the manner and for the period required by law and
the Zoning Ordinance of the City of Gilroy; and
WHEREAS, the said hearing on the appeal has been held on
October 18, 1971, at 8:00 p.m. in the Council Chambers in the
City Hall at Noo 7390 Rosanna Street, Gilroy, California, and
evidence was submitted upon the said application and appeal from
the findings of the Planning Commission, the City Council finds:
(1) That the proposed use is not properly located in
relation to the General Plan and to the community as a whole and
to other land uses and to transportation and services facilities
in the vicinity; and
(2) That the proposed use will adversely affect other
property in the vicinity or cause damage, hazard or nuisance to
persons or property; and
(3) That while the Planning Commission did not err in denying
the use permit, the appellant who has commenced a youth center
program at the above location and the youth benefitted thereby
would suffer hardship if they were forced to terminate such
program immediately, and, in its discretion the Commission should
have granted appellant a reasonable time to find a new location
and vacate the subject premises; and

WHEREAS, the City Council has determined that the said permit
prayed for should not be granted, but that appellant should be
given until December 31, 1971, to terminate the present use of
the premises.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Gilroy does hereby determine on appeal, that the said
use permit prayed for be and the same is hereby denied, and the
present use of the premises as a youth center shall be terminated
on or before December 31, 1971.
