RESOLUTION NO. 1603
A RESOLUTION DECLARING THE COUNCIL'S INTENTION
TO REQUIRE SUBDIVIDERS TO INSTALL A CONDUIT TO
FACILITATE INSTALLATION OF CABLE TV SERVICE IN
ALL NEW SUBDIVISIONS.
WHEREAS, Section 21.36-2 of the Gilroy City Code provides
that, among the improvements to be installed underground by each
subdivider, are basic utility services to serve each lot; and

WlfEREAS, a question has arisen as to whether the City
Council intends to require subdividers to install underground
cable TV service to all lots in new subdivisions.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Gilroy as follows:
1. The City Council hereby finds that cable TV is a very
popular service which is demanded quite frequently by residents
of new subdivisions, and to facilitate installation of such
service at minimum cost, subdividers will hereafter be required
to install a cable TV conduit in the utility trench at the same
time other basic utilities are installed to serve each lot
as one of the basic improvements designed to serve the future
residents of all new subdivisions.
20 The required trench shall be provided at subdividers
cost.
3. The subdivider shall pay in advance to the CATV company
the actual cost of labor and materials for the installation of
required cable and related equipment. The amount so paid
without deduction or offset, shall be repaid to subdivider
by the CATV company on a pro-rata basis as building construction
is completed on each lot of the subdivision.
4. This resolution is intended to clarify the policy of

the City Council with respect to such improvements in new
subdivisions.
PASSED AND ADOPTED this 15th day of November, 1971, by the
following vote:
