',:.~Mtt~~~i " '?'~ .~ !)::. if . , '~~,~~~J:,>.,: l.~l,d;Gt....~~ , - ~~~t1'~' t: \ ~)' '* . . ~ 1<1 '''",'' ".j RESOLUTION NO. 1434 A RESOLUTION MODIFYING PROCEEDINGS EIGHTH STREET IMPROVEMENT DISTRICT PROJECT NO. 1969-2 RESOLVED, by the City Council of the City of Gilroy, California, that WHEREAS, this Council did on the 6th day of October, 1969, adopt its Resolution No. 1393 of Preliminary Determination and of Intention which said Resolution provided that serial bonds to re- present unpaid assessments, and bear interest at the rate of not to exceed seven percent (7%) per annum would be issued thereunder in the manner provided in Bond Plan B, Chapter 12A, Article III, Division 3 of the Gilroy City Code, the last installment of which bonds were to mature not to exceed fourteen (14) years from the second day of July next succeedin g ten months from their date; WHEREAS, said Council did on the 15th day of December, 1969, award the sale of the bonds to be issued to represent unpaid assess- ments levied in the proceedings had under said Resolution of Pre- 1iminary Determination and of Intention; WHEREAS, said award was made subject to all of the terms and conditions set forth in the accepted bid therefor; and WHEREAS, one of the terms of said accepted bid provided that the last installment of said bonds to be issued to represent said unpaid assessments was to mature not to exceed four (4) years from the second day of July next succeeding ten months from their date. NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED and ORDERED, as follows~ 11-3 ~- 1. That serial bonds to represent unpaid assessments and bear interest at the rate of not to exceed seven percent (7%) per annum shall be issued in the manner provided in Bond Plan B, Chapter l2A, Article III, Division 3 of the Gilroy City Code, the last installment of which bonds shall mature not to exceed fourteen (14) years from the second day of July next succeeding ten months from their date, to wit: four (4) years from the second day of July next succeeding ten months from their date. 2. That Notice to Pay Assessments has been published and mailed to each owner of real property within the assessment dis- trict at his last known address as same appears on the tax rolls of the City or on file in the office of the Clerk of said City, or to both addresses, if said address is not the same, or to general delivery when no address so appears in the time, form and manner required by law. Said notice as published and mailed pursuant to said Code contained, among other things required by law, a statement that the last installment of said bonds to be issued to represent the unpaid assessments shall mature not to exceed four (4) years from the second day of July next succeeding ten months from their date. 3.
