Resolution 1436 RESOLUTION NO. 1436 RESOLUTION REQUESTING ALLOCATION OF TOPICS FUNDS FROM THE CALIFORNIA HIGHWAY COMMISSION FOR THE IMPROVEMENT OF LEWIS STREET - FOURTH STREET AND MONTEREY STREET, PRIOR TO COMPLETION OF AN AREAWIDE TOPICS PLAN. WHEREAS, there is in the urban area (hereinafter called IIAreall) of Santa Clara County, as defined by the 1960 Federal census within the City of Gilroy (hereinafter called "Gilroy'l) a large volume of vehicular traffic between the "Easterly" area and the IIWesterly" area which has been steadily increasing at a rapid rate causing problems with respect to highway capacity and safety, specifically in the form of traffic congestion, traffic delay, etc. at the specific location of "Lewis-Fourth II Street and IIMontereyl1 Street (hereinafter called "Location'l) WHEREAS, the Federal Government has selected the site of Fourth Street and Eigleberry Street (Within one block of the Location) as the site of the new Gilroy Post Office and said post office will create large volumes of traffic on Fourth Street, WHEREAS, in the interest of public health, safety and welfare, by reasons stated above, it is essential that an improvement project (herein- after called "Project") at the said location in the form of installation of traffic control signs, pavement markings, signals and a realignment of the street to facilitate movement and increase the safety of vehicular and pedestrian traffic be accomplished as soon as possible and WHEREAS, the City of "G i I roy" has comp 1 eted necessary steps to des i- gnate an area wide TOPICS Program Coordinating Agent, namely, the County of Santa Clara Board of Supervisors; (hereinafter called IIBoard") and WHEREAS, the Board has initiated action for the submittal of an application for Federal TOPICS Funds for assistance in the preparation of an area-wide TOPICS Plan and Study Report (hereinafter called "Studyll); there is reasonable certainty to believe that the study will be authorized by the Federal Government and completed within an 18 month period; and - 1 - 1~3? ,,,,,~,'I WHEREAS, the Board has submitted a proposed "tentative" primary Type I( System to the State and Federal Government for approval; and WHEREAS, IIGilroy" has reasonable certainty to believe that this project will be one of the top priority projects to be included in the area- wide TOPICS Plan to be prepared; and WHEREAS, the said project location is partly within the incorporated area of IIGi lroy" and said project location is included on a portion of a city street, and State highway which is included on an existing Federal-aid system within the area and is requested to be included by reason of urgent project need in the proposed tentative Type II Federal-Aid Primary System, and Federal- Aid funds, other than Topics Funds, are not available to complete this project, and in the opinion of "Gilroy", the said project would qualify for Federal TOPICS Funds; and WHEREAS, "Gilroy" desires to file with the Highway Commission of the State of California pursuant to Section I, Chapter 6 (commencing with Section 2300), Division 3, of the Streets and Highways Code (relating to the financing of Topics Projects) a request for an allocation of funds to construct said project; NOW. THEREFORE. BE IT RESOLVED BY "G I LROY" AS FOLLOWS: 1. That "Gilroy" does hereby request the California Highway Commission to allocate sufficient funds pursuant to Section 1, Chapter 6 (commencing with Sec- tion 2300), Division 3 of the Streets and Highways Code for the project at the location; IIGilroy" does further request the Commission to allocate for the fiscal year 70-71 the sum of $19,242. for IIGi1 roy". 2. That "Gilroy" agrees that its respective appropriate budget accounts shall reflect the following contributions to said project: F i sea 1 Yea r 70-]1 - "G i 1 roy" $42.758. 3. That "Gilroy'1has considered the effect of the proposed financing (71.31% Federal Funds, 28.69% local agency funds) in relation to apportionment of Federal ToPtCS Funds within the State of California. 4. That "Gilroy" shall acquire sufficient rights of way, if required, to assure completion of all stages of the ultimate facility, or that the - 2 - necessary rights of way will be acquired or satisfactorily protected before advertisement of the project for bids; So that IIGilroyll shall be the legal administrative agent for the TOPICS project and all funds for the construction of said project shall be accumu- lated and released through IIGi 1 roy~.
