RESOLUTION NO. 1445
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY AUTHORIZING A REQUEST
FOR ALLOCATION FROM STATE CROSSING PROTECTION CONSTRUCTION FUND FOR PARTIAL
REIMBURSEMENT OF THE COST TO THE CITY OF GILROY FOR CROSSING PROTECTION
AT SOUTHERN PACIFIC COMPANY CROSSING E-80.7 AT SEVENTH STREET (OLD GILROY
STREET RELOCATED).
WHEREAS, the 1953 California Legislature by Statutes 1953,
Chapter 1739 created a fund to assist local agencies in paying their share
of the cost of constructing automatic protection at grade crossings of
railroads and City or County streets or highways; and
WHEREAS, the 1961 California Legislature by Statutes 1961 Chapter
1302 Codified the provision as Section 1231 of the Public Utilities Code;
and
WHEREAS, Decision No. 49565 of the Public Utilities Commission
established a procedure for the submission of requests to the Commission
for allocation from the State Crossing Protection Construction Fund, which
requires that the legislative body of the local agency authorize filing of
the reques t;
NOW. THEREFORE. BE IT RESOLVED. that the Director of Public
Works be authorized to prepare and submit to the Public Utilities Com-
mission of the State of California a request for allocation from the State
Crossing Protection Construction Fund pursuant to Section 1231 of the
Publ ic Utilities Code for partial reimbursement of the cost to the City
of Gilroy for crossing protection improvement at Southern Pacific Company
crossing~ E-80.7 at Seventh Street (Old Gi lroy Street relocated).
