RESOLUTION NO. 1452
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
ADOPTING POLICY GUIDELINES FOR SERVICE STATION
DEVELOPMENT.
WHEREAS, after study, the Planning Commission and staff has
prepared and recommended adoption of the attached policy guide-
lines for future service station development in the City of
Gilroy, and good cause appearing therefore,
NOW, THEREFORE, BE IT RESOLVED that the Council of the City
of Gilroy approves the attached policy guidelines and adopts the
same for the regulation of future service station development in
the City of Gilroy.
PASSED AND ADOPTED this 6th day of April, 1970, by the
following vote:

CRITERIA AND STANDARDS FOR THE DEVELOPMENT OF SERVICE STATIONS
DEFINITION:
Automobile Service Station: A IIservice station'. is a facility limited to retail
sales to the public, on the premises, of gasoline, motor oil and lubricants
(or grease), motor fuels, travel aids, minor automobile accessories and minor
automobile servicing, minor repairs and maintenance, but not including general
automobile repair, engine rebuilding or reconditioning of motor vehicles,
coJllsion services such as body, frame or fender straightening and repair,
or overall painting of automobiles.
SITE DEVELOPMENT:
Minimum Lot Size: A minimum lot area of 20,000 square feet shall be required for
each service station site. The Planning Commission may approve a lesser size
site if the applicant can demonstrate exceJlence of design and layout.
Site Plan: A site plan shall be prepared at a minimum scale of JII = 20' and shal1
include surrounding property and the zoning thereof, landscaping and sprinkler
systems, curbs, driveways, parking, buildings, property lines, center line
and width of existing right of way, topographical survey, building elevations,
storm drainage, walls, fences, aJl Jocational and descriptive dimensions.
(Topographical survey may be put on separate sheet.)
landscape Plan: A detailed landscape plan shall be submitted showing location,
size, and species of all proposed plant materials.

Landscaping: Landscaped areas shall be established on all service station
sites. Landscaping shall comprise a minimum of ten (10) percent of the
net site area. In certain areas of higher land uses or smaller lot sizes
a lesser percent can be approved by the Planning Commission. The landscaping
in such areas shall be designed so as not to obstruct necessary sight
distance and traffic flow, shall offer adjacent residential and commercial
properties a degree of visual and audio screening, and shall be of such
quality as to enhance the site, maintain the character and integrity of the
neighborhood, and promote excellence of development.
Street Trees: Trees shall be planted and maintained in accordance with what-
ever street tree planting program may be available. Applicant should check
with city jurisdiction for species, size and spacing.
Driveway and Corner Planters: Such planters shall be required and the planting
material shall be low-growing, not over three feet (31) in height, generally
low-maintenance plant material which will not obstruct view of drivers and
customers. All other planters shall be located so as not to obstruct,
necessary sight distances or traffic flow.
Irrigation: A sprinkler system shall be provided In all landscaped areas.
Bubbler heads are recommended in raised and smaller landscaped areas. Nose
bibs are not acceptable for irrigation.
Landscaped Curbs: All landscaped areas shall be separated from the paved areas
by a minimum four (4) inch concrete curb.
Fences, Walls, and Decorative Screening: Materials, textures, colors and
design of fences, walls and screening shall be compatible with the on-site
development, the adjacent properties, and the neighborhood. Solid walls
such as masonry or wood and masonry, shall be required when the service

station borders residential development and shall be six feet (6') in
height and be of the solid type. Fences, walls or decorative screening
within the first twenty (20') of the street right of way line shall not
be over three feet (3') in height.
DESIGN:
Design Criteria: All environmental and design criteria shall be indicated on
the site development plan. The design shall be appropriate to the site
and the surroundings, traffic patterns, and activities in the area and be
pleasing to the eye. The development shall be in harmony with adjacent
developments and shall promote excellence of development within that area.
Service Bays: Sufficient space shall be provided to service vehicles efficiently.
lube room access shall be appropriate to the site and the neighborhood.
It is desirable that such Bays open to the rear of the structure.
Off-Street Parking: All service station development shall meet City off-street
parking and maneuvering standards, and shll ensure the safe movement of
vehicles and pedestrians. The arrangement of structures, islands, driveways,
parking and landscaping shall be designed as to ensure maneuvering ease, to
serve the community, and to least adversely affect adjacent properites. The
development shall provide three (3) spaces for each grease rack or working
bay plus one (1) space for each employee on duty.
Access Driveways: Driveways shall be designed and located to ensure a safe and
efficient movement of traffic on and off the site from the lane of traffic
nearest the curb. Driveways shall be no wider than thirty-six feet (36'),
and there shall be a minimum of twenty-four feet (24') between driveways.
Driveways shall be located no closer than ten feet (10') from property line
except situations of mutual use and consent, and shall not extend into the
return radius.

Clea'r-vtsfon Triangle: There shall be no visual obstruction over three feet (3')
in height or hung lower than ten feet (101) at all street intersections,
said triangle having sides forty feet (40') from the point of intersection
of the curb line projected.
Grading and Drainage:
Drainage shall be collected on-site and directed into a
positive storm drainage system. Drainage shall not be discharged across
adjacent public or private property or across sidewalks and driveways.
Floor elevation of main structure and gas pumps shall not exceed one foot
(11) or one percent (1%), or whichever is appropriate, above sidewalk grade.
If fill at property line exceeds one foot (I'), a retaining wall will be
required.
On-Site Lighting:
Lighting shall be designed, controlled and maintained so that
no light source is visible from off the property. No luminaire shall be
higher than twenty feet (20') above finished grade. No light source on
the property shall be directly visible, or be of such high intensity as to
cause a traffic hazard or shine directly onto adjacent properties.
Lubrication Equipment: Hydraulic racks and service pits shall be located within
the main structure.
Outdoor Storage and Refuse Areas: Any outdoor storage or refuse area shall be
fenced or screened from view and must be approved as to location and design.
STRUCTURES:
Main Structures: Main structure and pump island shall be architecturally
attractive and be appropriate to the character of the neighborhood.
Materials, textures and colors shall be compatible with surrounding uses.
Reflective, glossy, and fluorescent materials shall not be permitted.
Applicant's architect or designer shall integrate and upgrade each service
station site through good design.

SIGNS:
Sign Regulations: Maximum permissible sign area for all signs except in (2) (3)
and (6) below shall be 100 square feet; this may include one free standing
sign not to exceed 30 feet in height plus;
(2) One ground sign per station frontage not to exceed 15 square feet in
area, located so as not to obstruct free and clear vision of traffic or
traffic signs and devices; plus
(3) One freeway sign (if the service station is within 660 feet of the
nearest point of access on a freeway) not to exceed 65 feet in height nor
250 square feet in area. All freeway signs shall be approved by conditional
use permit and shall conform to the outdoor Advertising Act of the State of
California.
(4) Signs advertising items such as batteries, tires and other accessories
or products will only be allowed within the building.
(5) Free standing signs containing gasoline or diesel prices will not be
allowed. Price signs shall be ground signs as noted in section (2) above.
(6) Credit card and Trading stamp signs: One additional sign per business,
which shall contain all credit card and trading stamp emblems; total area of
sign not to exceed 7 square feet. More than one individual credit card or
trading stamp sign will not be allowed. There shall be no additional un-
approved sign banners, pennants, flags, spinners or any such similar attract-
ing device displayed at any time, except during the initial grand opening, a
30-day period in which banners and flags are allowed. There shall be no A-
frame or portable-type signs allowed on service station sites.

OPERATION:
The operation shall be confined to normal vehicle station activities as
described in the definition portion of these standards. Outside operations
shall be limited to the dispensing of gasoline, oil, water, pressured air,
the changing of tires and minor servicing. Outside displays shall be limited
to one oil rack at each pump island. One accessory structure such as a
temporary promotional merchandising stand or shelter and one attractive tire
rack will be allowed. These are to be done in good taste.
The sale or rental of boats, two-wheeled vehicles, trucks, cars, all types of
trailers, groceries, dairy products, garden supplies, and any other similar
uses of a storage or sales nature, are prohibited unless approved as a retail
store or outlet with appropriate area, and approved through a Conditional Use
Permit approved by the Planning Commission. Convenient cigarette or soft
drink dispensing areas are allowed and must be integrated within the design
of the station.
FIRE PREVENTION REQUIREMENTS:
Storage of Flammable liquids: A permit from the City Fire Chief's office shall
be required for storage of flammable liquids. All flammable liquids,
including waste oil, shall be stored underground.
