A RESOLUTION DIRECTING MAKING OF AMENDED
ASSESSMENT RE CERTAIN ASSESSMENTS UNDER
RESOLUTION NO. 1139
of Preliminary Determination and of Intention
LUCHESSA AVENUE IMPROVEMENT DISTRICT PROJECT NO. 1967-2
CITY OF GILROY
ASSESSMENT NOS. 7 And 8
RESOLVED by the City Council of the City of Gilroy, Santa
Clara County, California, that
WHEREAS, an assessment and diagram was made and filed with
the City Clerk of said City all pursuant to Resolution No. 1139
of Preliminary Determination and of Intention, adopted by the
City Council of said City on September 5, 1967, and the provi-
sions of the Gilroy City COde, and said assessment was confirmed
by said City Council on January 15, 1968, and recorded in the
office of the Superintendent of Streets of said City; and
WHEREAS, certain lots or parcels of land upon which there
are unpaid assessments against which bonds have been issued under
the provision of Bond Plan B, Chapter 12A, Article 3, Division 3
of said Gilroy City Code have been divided so that they no longer ,
conform to the original parcel boundaries as shown on said
assessment;
NOW, THEREFORE, IT IS ORDERED, that:
1. The Director of Public Works shall cause to be prepared
and filed with the City Clerk a report and amended assessment and
diagram of the lots or parcels so divided, said parcels being
designated Assessment Numbers 7 and 8.

2. That the unpaid installments of said original assessments i

shall be segregated and apportioned in accordance with the benefit~

amount of the assessments of the several portions of the original
lots or parcels shall be equal to the unpaid assessments upon
said original lots or parcels of land.
3. That Monday, the 4th day of May, 1970, at the hour of
8:00 o'clock P.M., at the regular meeting place of said Council,
Council Chambers, City Hall, Gilroy, California, be, and the same
are hereby fixed as the time and place for hearing said amended
assessment before the said Council.
4. That the City Clerk of said City shall advertise the
time and place of such hearing before the City Council by pub-
lishing a notice of said amended assessment twice in the Gilroy
Evening Dispatch, a newspaper of general circulation published
and circulated in said City, the first publication being not less
than fifteen (15) days before said hearing.
