Resolution 1525 RESOLUTION NO. 1525 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ADOPTING AN ANNEXATION AND DEVELOPMENT POLICY FOR THE CITY. WHEREAS, after study, the City Council deems it necessary for orderly growth to adopt an annexation and development policy for the City of Gilroy, and good cause appearing therefore, NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Gilroy approves the following policy guidelines and adopts the same for the regulation of future annexation and development in the City of Gilroy. 1. Annexation to the City of Gilroy shall be limited to territories included within the present General Plan of the City. Exception: When in the majority opinion of the City Council and with an overriding reason of particular benefit to the City, the City Council may, under its own motion, consider an annexation outside the limits of the present Gilroy General Plan. 2. All annexations shall be contiguous to the City. Exception: Where it is found to be impossible to annex a single ownership in extending an annexation along a public road, Council may allow the annexation to by-pass one such single ownership provided its roadway frontage does not exceed one-half (~) mile in length. 3. All costs of annexation and subsequent development of any specific ownership of lands shall be borne by the owner, his agent, or subsequent purchaser of such lands. These costs shall include but shall not be limited to the following. a. Annexation maps and descriptions. b. City development fees and charges. c. Costs of extending any city-owned utility services to the lands proposed for development. These costs shall include any oversizing of such services at the developer's expense. This shall not preclude the repayment of a portion of such costs to the developer provided an adjacent ownership, or ownerships, utilize the extended service during a ten (10) year period following the installation of the service. Such a reimbursement arrangement shall be Ulx1er the City's standard form of / ~~ 2~ Reimbursement Agreement. Further, this policy shall not preclude financing such service extensions under an assessment district procedure subject to the developer obtaining prior approval of the City Council and the cooperation of any affected adjacent ownerships.
