RESOLUTION NO. 1533
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY DECLARING A MORATORIUM ON R-3 (LOW DENSITY
MULTIPLE RESIDENCE) CONSTRUCTION UNTIL THE
ZONING ORDINANCE CAN BE AMENDED, UNLESS PRIOR
PLANNING COMMISSION APPROVAL OF DENSITY IS OBTAINED.
WHEREAS, recent R-3 (Low Density Multiple Residence)
developments on larger acreages in Gilroy have demonstrated a
need for revised density requirements to provide adequate open
space and recreational areas for the general welfare of the
inhabitants of such developments, and
WHEREAS, the Planning Commission bas studied the problem
and has initiated proceedings to amend the Zoning Ordinance so
as to provide for lesser density and more open space in future
R-3 developments in the City, and
WHEREAS, the Council wishes to prevent the construction of
overcrowded R-3 developments in the City during the time prior
to the adoption of new R-3 density regulations by amending the
Zoning Ordinance, and
WHEREAS, the Council has examined and approves in principal
the new densities for R-3 zones proposed by the Planning
Commission,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Gilroy:
1. That no R-3 (Low Density Multiple Residence) building
permits be issued in the City of Gilroy from the date of this
resolution until the effective date of new R-3 density
regulations by amendment of the Zoning Ordinance, unless either
the Planning Commission or Planning staff approves the density
of the new development utilizing the following R-3 density regu1a-
tions to make that determination:

For subdivided lots 24,000 sq. ft. or less
2,000 sq. ft. of land area for each 1 or 2 bedroom unit
3,500 sq. ft. of land area for each 3 bedroom unit
For acreage over 24,000 sq. ft.
2,000 sq. ft. of land area for each 1 bedroom unit
2,700 sq. ft. of land area for each 2 bedroom unit
3,700 sq. ft. of land area for each 3 bedroom unit
4 or 5 bedroom units in any area would require a Conditional
Use Permit
PASSED AND ADOPTED this 7th day of December, 1970, by the
following vote:
