Resolution 1537 RESOLUTION NO. 1537 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY PURSUANT TO THE PROVISION OF THE UNIFORM BUILD- ING CODE. WHEREAS, heretofore the Chief Building Official, acting as the "Enforcement Agency" pursuant to the Uniform Building Code 1967 Edition, Chapter 2, Section 203 et seq., did post a building and notify the owner of same that said building is sub-standard and a nuisance, the reasons for same being set forth; the affidavit of the Building Official relative to the posting and notice being on file in the proceedings herein; and WHEREAS, pursuant to the Uniform Building Code hereinbefore men- tioned, the Chief Bui 1ding Official did post a "Notice of Condemnation" on the form provided for by said Uniform Building Code; and WHEREAS, the said building has not been repaired or removed as re- quired by the Building Official; and WHEREAS, after evidence received from the Building Official and all other interested parties, the following appears: (a) That the sixteen (16) cabins (known as Rainbow Court) located at Seventh Street and East Street and shown as Assessor's Parcel 841-11-1 in the Assessor's Map Book and owned by Mrs. Rosie Minotti, 595 Old Gilroy Street, Gilroy, is unfit for human habitation or occupancy, for the reason that the following deficiencies exist: I) General dilapidation. 2) Has been reported a nuisance by the Gilroy Police Depa r tmen t_ 3) Deteriorating walls, ceil ings and floors. 4) Substandard electrical and plumbing_ 5) Lack of bathroom facilities. (b) That the property was posted on January 28, 1970 and the owner notified to begin demolition. (c) That the property owner was again notified to begin demolition on September 22, 1970. - 1 - / ,'j3 7 (d) That the property owner has accomplished some demolition but has discontinued efforts to complete demolition. NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Gilroy does hereby and on the basis of the hearing and evidence presented, conclude that the heretofore mentioned building is a nuisance, unfit for human habitation or occupancy, for the reasons heretofore set forth in the Ilwhereas" clauses, and does hereby direct the owner to abate the said building within ten (10) days after the date a copy of this resolution is posted on the said building. BE IT FURTHER RESOLVED, that it is the conclusion of the Council of the City of Gilroy that said building cannot be reconstructed or repaired in a manner so as to comply with the Uniform Building Code of the City of Gilroy, and therefore the said building must be razed or removed and the Bui 1ding Official is hereby authorized and required to so inform the owner of the said building. AND BE IT ALSO FURTHER RESOLVED, that if said building is not razed or removed within ten (10) days after the posting of this resolution on said building, the City of Gilroy may thereupon raze or remove the building herein declared to be a nuisance or have the same done under its direction and supervi- sion. The expense involved in razing or removal shall constitute a lien on the rea 1 property.
