RESOLUTION NO. 1316
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ACCEPTING IMPROVEMENTS MADE BY
DEVELOPERS OF THE SUBDIVISION KNOWN AS "CREEKSIDE WEST~. TRAn~ NO. t441" SUBJECT
TO STIPULATIONS AS SPECIFIED BY THE CITY ENGINEER. NO. 581
WHEREASi ROBERT MUNSON, developers, have heretofore subdivided a
tract of land in the City of Gilroy, designated as "CREEKSIDE WEST, TRACT NO.
4441", and in order to secure the acceptance and approval by the said City of
the Official Map of said subdivision, the said developer, did enter into an
Agreement on the 15th day of April, 1968, with the City of Gilroy, in which
they agreed to cause to be constructed, installed, and completed, certain im-
provements consisting of streets, highways or public ways, and sewer facilities,
curbs, sidewalks and gutters, catch basins, sewer lines and water pipe lines,
culverts, on-site and off-site storm drains, sanitary sewers, street lighting,
street signs, fire hydrants, and trees in accordance with and as required by
plans and specifications for said improvements and conforming to certain stan-
dards which were then on file in the office of the Clerk of the City of Gilroy
and did post a cashiers check in the sum of $33,000.00, to secure the performance
of the said work and the proper installation of the said facil itiesj and
WHEREAS, the Director of Public Works of the City of Gilroy has re-
ported to the said Council of the said City of Gilroy, that all of the said
facilities and improvements and utilities except Sixth Street west of Miller
Avenue have been furnished and installed by the said developers, in accordance
with the said Agreement and that the same are acceptable to the City of Gilroy
and that the said bond or cashiers check of said developer, should be cancel led;
NOW THEREFORE~ BE IT RESOLVED, that the said City of Gilroy does here-
by accept the said improvements, utilities and facilities as installed by the
said developer: ROBERT C. MUNSON, under the aforesaid Agreement as complying
with and as being in full conformance of the said contract subject to the fol-
lowing stipulations:
1) Developer shall repair all such defects as may be disclosed
therein during the period of one (1) year from and after this
acceptance of said facilities, utilities and improvements.

2) Developer shall sign an Agreement to maintain all off-site
drainage ditches adjoining said subdivision"
3) City shall retain $3,000.00 of said security to iAsure the
repair of the Sixth Street improvements w~st of Miller Avenue.
The Director of Public Works shall accept said improvements
and shall release said security upon acceptance. Developer
shall be obligated for repairs for one (I) year after accept-
ance. No bonding will be required.
4) Developer shall have a written report from a Tree Service
that al I trees are in a safe condition. Unsafe trees shall be
noted and removed or trimmed to a safe condition. Dead trees
shall be removed.
5) The developer shall provide the City with lias built" plans.
BE IT ALSO RESOLVED that the Director of Public Works shall retain
a portion of the subdivision bond or cashier check to insure the completion
of these items. The remainder of the bond or security shall be cancelled.
PASSED AND ADOPTED this 3rd day of February, 1969, by the following
vote:
