Resolution 1318 RES OLUTION NO.. 1318 RESOLUTION OF THE COUNCIL OF THE CITY OF G!LROY ACCEPTING IMPROVEMENTS MADE BY DEVELOPERS OF THE SUBDIVISION KNOWN AS "CASTLEWOOD PARK~ UNIT #5, TRACT #4419" SUBJECT TO STfPULATfONS AS SPECIFIED BY THE CITY ENGINEER. WHEREAS, CUGINI PROPERTIES, developers, have heretofore subdivided a tract of land in the City of Gilroy, designated as "CASTLEWOOD PARK~ UN[T#5, TRACT NO.. 4419", and in order to secure the acceptance and approval of the said City of the Official Map of said subdivision, the said developers, did enter into an Agreement on the 5th day of February 1968, with the City of Gilroy, in which they agreed to cause to be constructed, installed, and completed, certain improvements consIsting of streets, highways or public ways, and sewer facili- ties, curbs, sidewalks and gutters, catch basins, sewer lines and water pipe lInes, culverts, on-site and off-site storm drains, sanitary sewers, street lighting, street signs, fire hydrants, and trees in accordance with and as re- qui red by plans and specifications for said improvements and conforming to cer- tain standards which were then on file in the office of the Clerk of the City of Gilroy and did give a bond in the sum of $50,000.00, to secure the performance of the said work and the proper instaJlation of the saId facilitIes; and WHEREAS, the Director of Public Works of the City of Gilroy has re- ported to the said CeunciJ of the said City of Gi Jroy, that all of the said facIlitIes and improvements and utiJities have been furnished and installed by the said developers, in accordance with the said Agreement and that the same are acceptable to the City of Gi lroy and that the said bond of said developers, should be cancelled; NOW THEREFORE~ BE IT RESOLVED, that the said City of Gilroy does hereby accept the said improvements, utilities and facilities as instal led by the said developers: CUGINI PROPERTIES, under the aforesaid Agreement as comply- ing with and as being in full performance of the said contract subject to the following stipulations: 1) Developers shall repair al I such defects as may be disclosed therein during the period of one (1) year from and after this acceptance of said facilities, utilities and improvements. - 1 - /:318 2) Developers shall provide off-site drainage ditches easterly to drain the tract in addition to the dry wells now installed. No water shall pond above the sidewalks. 3) Developers shall sign an Agreement to maintain said off-site drainage ditches from the tract. 4) Developers agree to fill depressions in street areas with hot-mix and sand seal cracked pavement areas during dry weather. 5) Developers shall provide the City with liAs Bui It" plans. portion of the subdivision bond to insure the completion of these items.
