Resolution 1328 RESOLUTION NO. 1328 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY WITHDRAWING FROM THE GILROY RURAL FIRE PROTECTION DISTRICT TERRITORY THEREIN RECENTLY ANNEXED TO THE CITY OF GILROY UNDER THE DESIGNATION "THOMAS-MESA ANNEXATION 69-1 TO THE CITY OF GILROY". WHEREAS. there has heretofore and on the 18th day of March. 1969, been annexed to the City of Gilroy, under the designation of '~HOMAS-MESA ANNEXATION 69-1 TO THE CITY OF GILROY" the following described property located In the County of Santa Clara. State of California, to wit: BEING a portion of Las Animas Ranch Lots 11, 15 and 16 as shown on Map No.7 accompanying the Final Report of the Referees In the Las Animas Rancho Partition Suit, Action 5536 had in the Superiod Court of the State of California, in and for the County of Santa Clara. and being more particularly described as follows: "BEGINNING at the southwesterly corner of "Southwest Annexa- tion No. 65-2 to the City of Gilroy" as described in Resolu- tion No. 986 of said City, said point of beginning being in the southwesterly line of that certain 41.722 acre parcel of land described in the Deed from C. N. Smith to Frank Filice, et ux, recorded February l5. 1952 in Book 2366 at page 302, Official Records of Santa Clara County, and running thence along said southwesterly line S. 200 00' E. 42.55 feet to the southwesterly corner of said 41.722 acre parcel in the line common to Ranch Lots 16 and 15; thence along said Ranch Lot Line West 151.84 feet, more or less to the corner common to Lots 3 and 4 as shown on the "Map of the Massey Thomas Senior Subdivision of Las Animas Ranch Lot No. 15", which map Is flIed for Record in Book "G" of Maps at page 5'. Mc- Carthy by Deed recorded in Volume 4850 at page 453, Offi- cial Records of Santa Clara County; thence West along said projection and southerly line 860.11 feet to the southwesterly corner of said 3.009 acre parcel in the 1 i ne common to Lots 2 and 3 as shown on the IIt,tap of the Subdivision of Lots 3 and 16" above referred to; thence along sa I d common lot 1i ne Nor th 33(' .00 feet to the nor- therly common corner to said lots; thence East along the northerly line of Lots 3, 4 and 5 and the projection there- of 860.11 feet to the intersection thereof with the center- line of Thomas Road; thence along the centerline of Thomas Road North 2,076.68 feet, more or less, to corner common to Lots 9 and 13 in the center of Carnadero Creek as shown on said "Massey Thomas Senior Subdivision Mapll; thence along the line common to Lots 9 and a as shown on said Map N. 680 E. 145.86 feet and S. 49 E. 323.40 feet, more or less, to the corner of Lot 3 at the inter- section of the northerly line of Thomas Lane with the northed~erly line of Lot 9; thence continuing along the northeasterly line of Lot 9 S. 490 30.78 feet to the in- tersection thereof with the centerline of Thomas Lane; thence along the centerline of Thomas Lane S. 890 021 E. 440.09 feet, more or less, to t he intersection thereof with the southerly prolongation of the line common to Lots 2 and 3 as shown on said Map; thence along said pro- longation and the line common to Lots 1, 2 and 3 North 1,391.28 feet, more or less, to the northerly common cor- ner thereof in the line common to ranch lots l5 and 16; thence continuing along the prolongation of said common lot line North 40.00 feet to a point in the southerly line of said '~outhwest Annexation 65-2 to the City of Gilroy"; thence along said southerly line Westerly 795.95 feet, more or less to the point of begInning, and CONTAINING THEREIN approximately 145.4 acresll, and WHEREAS, said premises so annexed to the City of Gilroy were at the time of such annexation, included in and formed a part of the Gilroy Rural Fire Protection District, and the Council of the City of Gilroy desires that said territory so annexed be withdrawn from said fire protection dls- trlct. NOW, THEREFORE BE IT RESOLVED, that said territory hereinbefore - 3 - I' described and so annexed to the City of Gilroy as '~HOMAS-MESA ANNEXATION 69-1 TO THE CITY OF GILROY" be and the same is hereby withdrawn from said Gilroy Rural Fire Protection District.
