RESOLUTION NO. 1342
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY REQUESTING THE
STATE OF CALIFORNIA, DEPARTMENT OF PUBLIC WORKS, DIVISION OF
HIGHWAYS, TO RETURN TO ITS PREVIOUS POLICY OF PAYING FOR THE COST
OF RAISING CERTAIN SEWER MANHOLES (OWNED BY PUBLIC AGENCIES OTHER
THAN STATE) TO GRADE OCCASIONED BY THE IMPROVEMENT OF STATE HIGHWAYS
NOT FREEWAYS.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GILROY:
WHEREAS, the previous longstanding policy of the State of California,
Department of Public Works, Division of Highways (hereinafter called
Department), was to bear the cost of raising sewer manholes (owned by
public agencies other than the State of California) to grade, whenever
such manholes were required to be raised because of the improvement of
State of California highways not freeways; and
WHEREAS, the Department has now changed its previous position
and policy and is now requiring such other public agencies to bear the
cost of raising their own manholes to grade when the raising of such
manholes is required by the improvement of State of California highways
not freeways except when such manholes have been installed pursuant to
rights which preceded the State of California's right to such highways;
NOW, THEREFORE, the City Council of the City of Gilroy hereby
requests the Department to return to its previous policy of bearing the
full cost of raising sewer manholes to grade necessitated by the improve-
ment of State of California highways not freeways.
