RESOLUTION NO. 1343
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY ESTABLISHING CERTAIN FEES FOR ENGINEERING
AND INSPECTION SERVICES PERFORMED BY THE CITY.
BE IT RESOLVED, by the Council of the City of Gilroy:
WHEREAS; the previous policy of the City to bear all
costs for engineering and inspection services for subdivisions
and developments containing public improvements has resulted
in excessive costs to the city for the primary benefit of
said developers and not the general public;
NOW, THEREFORE, BE IT RESOLVED that subdividers, property
developers and owners shall be required to pay the following
engineering fees to the city for engineering and inspection
services rendered by the city in connection with the installa-
tion of all public improvements:
(A) The minimum engineering fee shall be computed at
the rate of three (3%) percent of the total cost of public
improvements being installed by the developer or landowner.
(B) In addition, the developer or landowner shall pay
extra costs incurred by the city for all engineering and
inspection services requested by the developer, contractor
or landowner and performed by city personnel on Saturdays,
Sundays, holidays or before 8 a.m. or after 5 p.m. on
regular working days. Such fees shall be due and payable
upon demand of the city.
