~ RESOLUTION APPOINTING ENGINEER AND ATTORNEYS
SOUTH CHESTNUT STREET EXTENSION UNIT NOo 2
PROJECT NOo 1969-3
RESOLVED>> by the City Council of the City of Gilroy.? Cali-
fornia>> that
WHEREAS>> this Council has determined to undertake proceedings
pursuant to appropriate assessments and assessment bond acts for
the acquisition and construction of public improvements in said
City; and
WHEREAS, the public interest and general welfare will be
served by appointing and employing engineers and attorneys for
the preparation and conduct of said proceedings and work in con-
nection with said improvements;
NOW>> THEREFORE>> IT IS ORDERED>> as follows~
10 That the City Engineer>> City of Gilroy" California>> be,
and he is hereby>> appointed as the engineer on said project and
employed to do and perform all engtneering work necessary in and
for said proceedIngs" including all prel.iminary surveying, prep-
aration of report" plans, profiles. specifications, inspection.
estimate of costsJ> diagram>> assessment>> setting grade stakes and
supervision of' work; that his compensatton bey and it is hereby))
fixed at a reasonable fee for all of said engineering)) said fee
to be approved by the City Council and assessed as an incidental
expense of said proceedings 0

relating thereto when called upon, and furnishing their legal
opinion on the validity of said proceedings and bonds, and that
their compensation be, and it is hereby, fixed at two percent (2%)
of the acquisition and construction cost, exclusive of incidentals,
or $7500009 whichever may be greater, together with reasonable fees
for services i.n acquiring easements or in eminent domain or other
suits if referred to them, to be assessed as an incidental expense
