A RESOLUTION REQ,UESTING CONSENT OF THE BOAHD OF
SUPERVISOHS OF THE COUNTY OF SANTA. CLAHA TO
rHE EXERCISE OF EXTRI-\ITERRI'TORIAL JURISDICTION
TO UNDERTAKE PROCEEDINGS FOR IIHE ACQUISITION
AND CONSTHUCTION OF PUBLIC IMPROVEMENTS AND
TO PROVIDE THAT THE COSTS SHALL BE ASSESSED
UPON THE DISTRICT BENEFITEDj UNDEH APPROPRIATE

RESOLVED~ by the City Council of the City of Gilroy,9 Cali-
fornia.9 that
'>JHEREAS.9 it is the intention of this Council to undertake
appropr.iate special assessment and assessment bond proceedings
for the acquisition and construction of the improvements herein-
after described;
WHEREASJ) this Councll proposes to assess the costs of said
acquisitions and improvements and the expenses incidental thereto
upon a distr:lct benefited thereby J) the exter:lor boundaries of whi.ch
are the coterminous exterior boundaries of the composite and con-

thereof on file :In the off:lce of the City Clerk;
WHEREAS.9 a portlon of said improvements to be made are within
unincorporated territory of the County of Santa Clara, and a
po:tot:1.on of th.e lands to be assessed to pay the costs and expenses
thereof is uninco:rpor'ated territory within said County;

a) The acqu:lsition of property necessary for the opening
of a new street of the uniform width of 86 feet from the inter~
se Ion of Eighth Street and Chestnut Street, as it now exists)>
runn.ing th.ence generally sou.theasterly 1850 feet j more or less)>
as more particularly shown on the map of official plan lines
for Chestnut Street.9 thence leavIng said adopted plan lines and
running generally southerly 1500 feet,9 more or less,9 to the
existing northerly terminus of South Chestnut Street at the
Prtncevalle storm drain channel 800 feet9 more or less, westerly
of the westerly line of th.e proposed U.S 0 101 Highway.9 and the

nection of said sewer and water facilities to existing facili-
ties of the City of Gilroy.
b) The acquisition of all lands and easements and the per'form-
ing of all work. auxiliary to any of the above necessary to complete
the same.
WliER-EAS) said acqu:Lsitions and improvements to be made are of
such a chara er that they will directly and peculiarly affect
property not only within the boundaries of the City of Gilroy but
also the unincorporated territory within the County of Santa Claras
and purposes sought to be accomplished can best be accomplished
a si:ngle comprehensIve scheme of work;
WHEREAS. there has been filed with this Council a form of

the contractor that all of the proviSions of the specifications are
with by the contractor. to the end that no greater amount
s are open at any time than is necessary. that they shall

backfilledj and that the pavement shall be restored with materials
of like quality and character as those existing therein at the time
of such work and to its former condition and state of usefulness
as nearly as may be.
