RESOLUTION NO. 1374
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
DENYING THE REVISED APPLICATION OF HYMAN WEISEL TO
PREZONE 83.38 ACRES AS R-2 (TWO FAMILY RESIDENCE),
67.17 ACRES AS R-l (SINGLE FAMILY RESIDENCE) AND
7.14 ACRES AS C-l (NEIGHBORHOOD COMMERCIAL), A TOTAL
OF 154.69 ACRES, SAID PROPERTY BEING PART OF A
PROPOSED ANNEXATION FILED WITH THE CITY OF GILROY
WHEREAS, the application has heretofore been made by
HYMAN WEISEL to the Planning Commission of the City of Gilroy
for the prezoning of 27.53 acres as R-3-X (High Density
Multiple Residence), 36.97 acres as R-3 (Low Density Multiple
Family Residence), 18.88 acres as R-2 (Two Family Residence),
64.17 acres as R-l (Single Family Residence) and 7.14 acres as
C-l (Neighborhood Commercial), a total of 154.69 acres, and
WHEREAS, the Planning Commission of the City of Gilroy
has given due notice of a public hearing upon the said
application, in accordance with the Zoning Ordinance of the
City of Gilroy, has held the hearing, and has made its report
to the Council of the City of Gilroy, in which it recommended
that pre zoning be denied; and
WHEREAS, the City Council referred the matter back to
the Planning Commission for a recommendation on a revised
application to prezone 83.38 acres as R-2, 64.17 acres as R-l
and 7.14 acres as C-l, and the said rehearing now having been
held, and the Planning Commission having again made its report
to the Council in which it recommends that pre zoning be
denied; and
WHEREAS, the Council of the City of Gilroy fixed the 7th
day of July, 1969, at the hour of 8:00 o'clock p.m. in the
Council Chambers in the City Hall at No. 10 South Rosanna
Street, Gilroy, California, as the time and place for hearing
the said report and recommendation upon the original application,
and notice of the said hearing has been given in accordance
with the said Zoning Ordinance, and a public hearing has now
been held upon the original application, at the time and place
fixed in the said notice, before the Council, and continued
to this date for hearing on the amended application, and the
Council having duly considered the said amended application
and the evidence presented, and having determined that the
amended application for pre zoning should be denied in
accordance with the report and findings set forth in Planning
Commission Resolution No. 441.
NOW THEREFORE, BE IT RESOLVED that the City Council of
the City of Gilroy does hereby adopt the findings of the
Planning Commission and does hereby determine that the said
amended application for prezoning be and the same is hereby
denied.
