Resolution 1389 RESOLUTION NO. 1389 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY PROVIDING THAT NO OBJECTIONS HAVE BEEN MADE TO THE DEMOLISHING AND REMOVAL OF THE DWELLING FORMERLY LOCATED AT AND KNOWN AS NO. 223 EAST SIXTH STREET IN GILROY, CALIFORNIA, AFTER NOTICE DULY GIVEN AND THAT THE COST OF SUCH DEMOLITION AND REMOVAL SHALL BE CHARGED TO THE OWNERS OF THE PROPERTY AS A SPECIAL ASSESSMENT ON THE LAND ON WHICH THE BUILDING WAS LOCATED AND THAT THE SAME SHALL BE COLLECTED IN THE MANNER AS A SPECIAL ASSESSMENT. WHEREAS, the dwelling premises known as and located at 223 East Sixth Street in Gilroy, California, have heretofore been reported to the Building Offices or the Official performing his duties of said City as being in a dilapidated, dangerous, and unsafe condition and as constituting a fire hazard and said Building Official has examined said building and has found said report to be true, and in accordance with Section 203 of the Building Code has given the owners of said building written notice of said condition of said building and requiring them to commence, within forty-eight (48) hours after receipt of said notice to repair said structure or demolish and remove the same, all as required by said Section 203, and more than forty-eight (48) hours have elapsed since said notice was so given and no steps whatever have been taken to comply with said notice but, on the contrary, the building has further deteriated and become more unsafe and hazardous; and WHEREAS, in accordance with Section 203 of the Uniform Building Code, 1961 Edition, heretofore adopted by the Council as the Building Code of the City, Notice requiring the owners of the property to demolish and remove the said building from the said premises in accordance with the provisions of said Section 203 of the said Building Code was given to the 13~.~'7 I owners of the property and who did nothing to cause the removal of said building and the City did proceed with the demolition and removal of said building in accordance with subdivisions (d) and (e) of said Section 203, and the said building has been demolished and removed and the cost thereof is the sum of $2,000.00 which the City of Gilroy has paid out of the City Treasury; and, WHEREAS, the said Section 203 of the Uniform Building Code of the City of Gilroy provides that the City Council shall cause the cost of such removal and demolition to be paid and levied as a special assessment against the property and the same shall be collected in the manner provided for special assessment, and WHEREAS, the Council did fix September 2, 1969, at the hour of 8:00 p.m., in the Council Chambers in the City Hall at No. 10 South Rosanna Street, Gilroy, California as the time and place for hearing objections to said cost and the proceedings for assessing the cost against the said land, and notice of said hearing was given as required by law, and said hearing has been held and no one appearing to object to the said cost or proceedings. NOW, THEREFORE, BE IT RESOLVED and ordered that the said sum of $2,000.00, the cost of said demolition and removal of said building, was and is reasonable and proper; that due notice of the proceedings for charging said cost against said premises as a special assessment have been given and that the said cost of $2,000.00 shall constitute a lien against the land hereinafter described until paid and shall be collected with other taxes assessed against the property in the same manner as general City taxes and shall be subject to the same penalties and interest and the same procedure and sale in -2- case of delinquencies as provided for City taxes; and BE IT FURTHER ORDERED that a certified copy of this Resolution be delivered to the officers performing the duties of assessor and tax collector for the City of Gilroy to the end that said costs be assessed as hereinabove provided against the land described as follows: All that real property located in Gilroy, Santa Clara County, California, commonly known as 223 East Sixth Street, Gilroy, California and consisting of Santa Clara County Assessor's parcel No. 841-06-036.
