RESOLUTION NO. 1426
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
ORDERING THE IMPROVEMENTS OF THE EAST AND WEST
SIDES OF MONTEREY STREET BETWEEN THE CENTER LINE
OF FOURTH STREET EXTENDED AND THE CENTER LINE OF
SIXTH STREET, AND ONE-HALF BLOCK PORTIONS OF
INTERSECTING STREETS, UNDER THE TREE PLANTING ACT
OF 1931.
WHEREAS, the City Council of the City of Gilroy did on
December 1, 1969, adopt its resolution of intention to
improve the East and West Sides of Monterey Street between
the center line of Fourth Street Extended and the center
line of Sixth Street, and one-half block portions of intersect-
ing streets, under the Tree Planting Act of 1931, by its
Resolution No. 1417, and
WHEREAS, said Resolution No. 1417 did fix the 15th day
of December, 1969, at the hour of 8:00 p.m. in the Council
Chambers in the City Hall at No. 10 South Rosanna Street,
Gilroy, California, as the time and place for hearing any
persons who may wish to appear and give reason, if any, why
the proposed improvements should not be made and the
assessments levied pursuant to Resolution No. 1417 and the
plans on file with the City Clerk of the City of Gilroy, and
the notice of said hearing has been given as required by law,
and a public hearing having been heard upon said proposal at
the time and place fixed in said notice before the Council,
and the Council having duly considered the evidence presented
in favor of and in opposition to said improvement, and having
determined that said improvement should be made according to
the resolution of intention and the plans filed therewith.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Gilroy:

overruled.
2. The City Forester is hereby ordered to proceed with
the improvements described in the City Council Resolution
No. 1417 and the plans filed therewith.
3. After allowing for contribution by City staff services
and the planting of the trees by City employees the balance
of the cost of the project of $7,642.51 shall be assessed at
the rate of $3.60 per front foot along Monterey Street to
the owners by assessor's parcel numbers according to the front
footage and in the total amounts set forth in Exhibit "A"
annexed hereto and consisting of five (5) pages.
PASSED AND ADOPTED this 15th day of December, 1969, by
the following vote:
