Resolution 1226 RESOLUTION NO. 1226 A RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY, AMENDING SECTION VI-B AND ADDING SECTION VI-K TO THE CITY OF GILROY PERSONNEL RULES AND REGULA- T IONS. WHEREAS, the City Administration has informally been granting certain sick leave and emergency leave benefits as required by employees, and; WHEREAS, the City Administration has presented said informal procedure to the Personnel Commission for review, guidance and adoption of a formal policy, and; WHEREAS, the Personnel Commission has reviewed said informal procedures and studied procedures of private and public industry, and; WHEREAS, the City Council desires to formally establish said procedure. NOW THEREFORE, BE IT RESOLVED that the City of Gilroy Personnel Rules and Regulations are hereby amended to read: SECTION VI-B (SECOND PARAGRAPH): "An employee's sick leave wi 11 be affected when he is injured on the job and is unable to work, and; a. He will continue to accumulate monthly sick leave credit, as established by the Gilroy City Code, Section 17 (one day per month). b. His accumulated sick leave will be charged for each day he is absent from work. When benefits are received from State Compensation Insurance Fund the employee will be given the option of receiving the amount of the benefit or sick leave as follows: a. If the employee desires to receive the amount of the benefit check, his monthly salary will be reduced by the number of days covered by the benefit check. b. If the employee desires to receive sick leave, his accumu- lated sick leave will be charged for each day he is absent from work, and the employee1s accumulated sick leave will be credited for the amount of the benefit check. (Computed by dividing his daily salary into the amount of the benefit check.) SECTION VI-K, EMERGENCY LEAVE: An employee may be granted emer- gency leave by the City Administrator not to exceed five (5) days to care for sick dependents. The employee is given the option - 1 - /2z0 of deducting this leave from either his accumulated sick leave or his earned vacation. BEREAVEMENT LEAVE: An employee may be granted up to five (5) days bereavement leave by the City Administrator for the passing of: husband, wife, child, mother, father, brother sister, grandmother, grandfather, mother-in-law, father-in- law or other relative if he had been 1 iving with the em- ployee at the time of death. The employee is given the option of deducting this leave from either his accumulated sick leave or his earned vacation."
