RESOLUTION NO. 1227
A RESOLUTION CREATING A SPECIAL FUND TO BE KNOWN AS "CITY OF
GILROY LUCHESSA AVENUE IMPROVEMENT DISTRICT FUND"
LUCHESSA AVENUE IMPROVE~mNT DISTRICT
PROJECT NO. 1967-2
RESOLVED, by the City Council of the City of Gilroy,
California, that
WHEREAS, the City has instituted proceedings for undertaking
the work and improvements pursuant to Resolution No. 1139 of
Preliminary Determination and of Intention adopted by this Council
on September 5, 1967, as subsequently amended, and the Municipal
Improvement Act of 1913j
WHEREAS, said improvements included the construction of
crossing signals at the intersection of Luchessa Avenue and the
drill track to be constructed in said proceedingsj and
WHEREAS, Section 10209 of said Municipal Improvement Act of
1913 provides that this Council, to expedite the making of said
acquisitions and improvements, may at any time transfer out of
any available funds such sums as it deems necessary and that any
sums so transferred are a loan and shall be repaid out of the
proceeds of the assessments.
NOW, THEREFORE, IT IS ORDERED, as follows:
1. A special fund, to be known as the City of Gilroy
Luchessa Avenue Improvement District Fund be, and it is hereby
created.
2. The sum of 010,000, and such other sums as the Council
may hereafter order, shall be transferred from the general fund or
from other available funds of the City to said fund hereby created.
3. The moneys in said fund shall be expended for the cost of
the construction of said crossing signals at the intersection of
Luchessa Avenue and said drill track.

4. Said fund shall be reimbursed from the assessments to
be collected and the proceeds of the bonds to be issued in said
assessment proceedings and from such other sources as the Council
shall hereafter determine.
5. When the purposes for which said fund is created have
been fully accomplished, all moneys remaining therein shall be
returned to the general fund or to such other funds as transfers
were made to said fund, and said fund shall be discontinued.
6. A certified copy of this resolution shall be filed in
the office of the City Treasurer.
