Resolution 1116 r- RESOLu'rION NO.J..llL RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY DETERMINI\JG THE APPEA.L OF MARY GI1\CHINO FROM THE ORDER OF THE PLANNING COMMISSION DEN~ING AN APPLICA- TION FOR A VARIANCE FROM THE REQUIREMENTS OF THE OFF-STREET PARKING SPACES REQUIRED BECAUSE OF A CON- TEMPLATED IMPROVEMENT TO THE GIACHINO PR&~ISES LOCA- TED AT THE CORNER OF FIRST AND HANNA STREETS BY THE DECISION OF THE PLANNING CO~~ISSION. WHEREAS, MARY GIACH1NO, has heretofore filed an application with the Planning Commiss ion of the City of Gilroy for a Variance authorizing her to furnish less than the required number of park- ing spaces for an improvement to the Hecker Pass Inn premises 10- cated at First and Hanna Streets in the City of Gilroy and the said Planning Commission after giving notice of the hearing and holding said hearing in accordance with the notice and receiving evidences upon the application, denied the application for a Vari- ance; and WHEREAS, the said MARY GIACHINO has appealed to the Council of the City of Gilroy from the adverse decision upon the said ap- plication and the Council has heretofore fixed the 1st day of May, 1967, at the hour of 8:00 o'clock p.m., at the Council Chambers in City Hall, No. 10 South Rosanna Street, Gilroy, California, as the time and place of the hearing of said appeal and application and notice thereof has been given in accordance with the Zoning Ordi- nance of the City of Gilroy; and WHEREAS, the said appeal has now come on for hearing before the City Council at the time and place fixed in said notice and evidence has been presented to the Council upon the said matter and the Council has duly considered the same; and WHEREAS, the said Planning Commission, in its said decision refusing to grant the Variance, determined: (1) That there are no exceptional or extraordinary circum- stances applying to the property involved or to the proposed use; - 1 - ///Ip (2) That no unnecessary hardship will result as a result of the denial of the application; (3) That the allowance of the Variance will under the circumstances of the particular case, be materially detrimental to the public welfare and materially injurious to persons or property in the vicinity, and (4) That the resulta of allowing the Variance as specified will not be in harmony with the general intent of the Zoning Chapter; and WHEREAS, the Council after hearing the evidence produced at this hearing has determined: That the decision of the Planning Commission upon the said application shall be affirmed. NOW THEREFORE BE IT RESOLVED and it is hereby ordered that the deter- mination and decision of the Planning Commission upon said application for a variance be affirmed and that the application be denied.
