RESOLUTION NO. ~ RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION TO CITY OF GILROY OF UNINHABITED TERRITORY DESCRIBED HEREIN .AND DESIGNATED "MONTEREY NORTHWEST ANNEXATION 65-4 TO THE CITY OF GILROY" .AND GIVING NOTICE OF TIME .AND PLACE FOR HEARING OF PROTESTS THERETO BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GILROY .AND IT DOES HEREBY FIND: 1. That pursuant to the provisions of the Annexation of Unin- habited Territory Act of 1939, a petition signed by the owners of all of the land in the hereinafter described territory, by area and by assessed value as shown on the last equalized assessment roll of the County of Santa Clara, was filed with the Council of the City of Gilroy on December 22 , 1962., requesting annexation of the hereinafter described territory to said City. 2. That the territory which the petitioners request be annexed to the City of Gilroy and which said City and its Council propose to annex is contiguous to the northwesterly city limits of said City, contained less than 12 registered voters at the time said petition was filed, and still contains less than 12 registered voters, and is uninhabited territory as defined in the Annexation of Uninhabited Territory Act of 1939, is hereby designated "MONTEREY NORTHWEST ANNEXATION 65-4 TO THE CITY OF GILROY", is located in the County of Santa Clara, State of California, and is described as follows: BEING a portion of Ranch Lot 32 as shown on Map No. 7 accompanying the Final Report of the Referees in the Las Animas Rancho Partition Suit, Action No. 5536 had in the Superior Court of the State of California, in and for the County of Santa Clara, and being also all of Lots 4, 5, 6, 7, and 8 and a portion of Lot 3 as shown on Map entitled, "Map of Jas. A. Clayton & Cots. Subdivision of Las Animas Ranch Lot 31 and a part of Las Animas Ranch Lot No. 30", which map is filed for record in Volume "V" of Maps at pages 1 and 2, Records of Santa Clara County, California, and being more particularly described as follows: "BEGINNING at a point in the centerline of Farrell Avenue distant thereon S.67&34'W. 181.00 feet from the corner common to Lots 3 and 4 as shown on said Map of the Clayton Subdivision, said point of beginning being also the north- westerly corner of that certain 1.601 acre parcel of land shown on Record of Survey Map filed for record in Book 9 of Maps at page 18, Santa Clara County Records, and running thence along the centerline of Farrell Avenue N.67~34'E.787.l0 feet, more or less, to the southwesterly corner of that ( 1) (/-' c // (, / certain parcel of land conveyed to Gabriel G. Lepiane and Carmen U. Lepiane by Deed recorded under Serial No. 465183 in the Office of the Recorder of Santa Clara County; thence along the westerly line of said Parcel N.22G20'W.100.00 feet to the northwesterly corner thereof; thence along the northerly line of said Parcel and the prolongation thereof N.67G34tE.475.00 feet, more or less, to the intersection thereof with the northeasterly line of the Southern Pacific Failroad; thence along said north- easterly line S.22020'E.2824.00 feet, more or less, to the intersection thereof with prolongation easterly of the northerly line of Ranch Lot 25 as shown on said Map No. 71' thence along said prolongation and northerly line of Ranch Lot 25 S.88035IW. 187.35 feet, more or less, to the intersection thereof with the southwesterly line of the State Highway (U.S.10l); thence along southwesterly line of said Highway N.22520'W.686.30 feet to the north- easterly corner of that certain Parcel of land described in the Deed to Gustav H. Steele and Barbara Steele, recorded December 8, 1949, in Volume 1888 at page 184, Official Records of Santa Clara County; thence along the northerly line of said Parcel S.88835"W.19l.53 feet, more or lessl to the northwesterly corner of said Parcel; thence along the westerly line of said Parcel and the southerly prolongation thereof S. l025'E. 170.00 feet to the inter- section thereof with the centerline of Liman Avenue as shown on the ffMap of North Gilroy Tract", which map is filed for Record in Book JlW" of Maps at pages 14 and 15, Records of Santa Clara County; thence along the centerline of Liman Avenue S. 88035'W. 118.75 feet to an intersection with the southerly prolongation of the easterly line of that certain Parcel of Land described in the Deed to Glenn C. Defebaugh, et ux, Recorded in Volume 4407 at page 476, Official Records of Santa Clara Co~nty; thence along said prolongation and easterly line N. 20201W. 170.02 feet to the northeasterly corner of said Parcel conveyed to Defebaugh; thence along the northerly line of said Parcel and the westerly prolongation thereof (being 150.00 feet northerly at right angles from the northerly line of Liman Avenue) S.88-351W.559.05 feet, more or less, to a point in the centerline of Carlyle Avenue that is N.221!201W. .181.99 feet from the intersection of the centerlines of Carlyle and Liman Avenues as shown on said "Map of North Gilroy TractJl; thence along the centerline of Carlyle Avenue N.22020'W. 484.00 feet, more or less, to the north- easterly corner of Lot 1 in Block 7 as shown on said ffMap of North Gilroy Tract"; thence along the northerly line of Lot 1. 288034130" W. 96.28 feet to the southeasterly corner of Lot 9 as shown on the Map of the Clayton Subdivision above referred to; thence along the northeasterly line of Lot 9 N.220l8t30"W. 182.04 feet to the most southerly corner of that certain 1.744 acre parcel of land shown on the Record of Survey Map first above referred to; thence along the southwesterly line of said 1.744 acre parcel and the 1.601 acre parcel shown on said Record of Survey Map. N.53&e5IW. 353.73 feet and N. 22a18'30ffl053.00 feet to the point of beginning, and CONTAINING THEREIN approximately 52.05 acres.1I 3. That said petition contains the written consent of all of the petitioners to the annexation. ( 2) 4. That a notice of intention to annex the said premises has been filed with the Local AgencYFo r mat ion Comrniss ion, pursuant to Section 54794 of the Goverrunent Code, and said Local Agency Forma;.... tion Commission of Santa Clara County has fixed the date, t~e and place for a public hearing upon the proposed annexation, given the notice that is required by Section 54796 of the Goverrunent Code, has held the said hearing in accordance therewith, made its deter- mination upon the proposed annexation and has approved said annexation as proposed. 5. That Monday, the 17th day of January, 1966, at the hour of 8:00 oiclock, p.m.; in the Council Chambers in the City Hall at No. 10 South Rosanna Street, in the City of Gilroy, County of Santa Clara, California, is hereby fixed as the t~e and place when and where any person owning real property within the City of Gilroy who does not also own real property in the territory proposed to be annexed and having objections to the proposed annexation may appear before the Council of the city of Gilroy and show cause why such uninhabited territory should not be so annexed to the City of Gilroy. The protest must be i~ writing, may be filed at any t~e before the hour set for hearing objections to the proposed annexa- tion, and shall state the name or names of the owner or owners of property affected and the description and area of such property, in general terms. 6. The City Clerk of the City of Gilroy is hereby authorized and directed to cause a copy of this resolution to be published at least once in the Gilroy Evening Dispatch, a newspaper of general circulation published in said City of Gilroy, the city to which it is proposed to annex the aforesaid territory, in the County of Santa Clara, California, the county in which is located the terri- tory proposed to be annexed to the City of Gilroy, said publication to be complete at least four (4) days prior to the date set for hearing. ( 3) 7. The city Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law.
