RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION TO
~t~y OF GILROY OF UNINHABITED TERRITORY DESCRIBED
HEREIN AND DESIGNATED uHECKER PASS-MOREY AVENUE
ANNEXATION 66-1 TO THE CITY OF GILROYu AND GIVING
NOTICE OF TIME AND PLACE FOR HEARING OF PROTESTS
THERETO
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GILROY AND IT
DOES HEREBY FIND:
1. That pursuant to the provisions of the Annexattion of
Uninhabited Territory Act of 1939, a petition signed by the
owners of all of the land in the hereinafter described territory,
by area and by assessed value as shown on the last equalized
assessment roll of the County of Santa Clara, was filed with the
Council of the City of Gilroy on
April 15, 1966, requesting
annexation of the hereinafter described territory to said City.
2. That the territory which the petitioners request be
annexed to the City of Gilroy and which said City and its Council
propose to annex is contiguous to the
westerly
city limits
of said City, contained less than 12 registered voters at the time
said petition was filed, and still contains less than 12 registered
voters, and is uninhabited territory as defined in the Annexation
of Uninhabited Territory Act of 1939, is hereby designated ItHECKER
PASS-MOREY AVENUE ANNEXATION 66-1 TO THE CITY OF GILROY", is
located in the County of Santa Clara, State of California, and
is described as follows:
BEING all of Lots 2 and 3 and a portion of Lot 4 as shown
on "Map of a subdivision of the lands of S. P. Fine in the
Solis Rancho", which map is filed for Record in Book uF-2"
of Maps at page 46 Records of Santa Clara County, California,
and being also all of Lots 27, 28, 33 and a portion of Lots
12, 18, 25, 26 and 29 as shown on "Map of Henry Miller's
Subdivision of Li3.s Animas Ranchlot 23" which map is filed for
record in Book "H" of Maps at page 5, Records of Santa Clara
County, and being more particularly described as follows:
BEGINNING at the intersection of Hecker Pass Highway
(shown as Bodfish Mill Road on said Maps) with the line
common to the Solis and Las Animas Ranchos (being also
the centerline of Morey Avenue or Anson Lane) and running
thence along the centerline of Hecker Pass Highway
S. 70-36'W. 24.91 feet to the intersection thereof with

~he northerly prolongation of the line common to Lots 1
and 2 of said S.P.Fine Subdivision; thence along said
common lot line S.4030'W.2999.50 feet to the southerly
common corner thereof; thence along the southerly line
of Lot 2 as shown on said Map S.86045IE.395.34 feet to
the southerly common corner to Lots 2 and 3 as shown
on said Map; thence along the line common to Lots 2 and
3 N.4030tE.3046.35 feet to the intersection of said Lot
line prolonged with the centerline of the Hecker Pass
HighwaYi thence along the centerline of the Hecker Pass
Highway N.88045IE.664.59 feet to the intersection thereof
with the northerly prolongation of the easterly line of
that certain 5.00 acre parcel of land conveyed by Leonides
Fine and E.R.Doyle by Deed recorded May 12, 1914, in
Volurn~ 413 of Deeds at page 558, said point of intersection
being in the westerly line of "Southwest Annexation 65-1"
to the city of Gilroy as described in Resolution No. 951
of the City Council of said City adopted August 4, 1965i
thence along said westerly line N.4030'E.33.17 feet to
the northwesterly corner of said Annexation in the northerly
line of Hecker Pass Highway; thence along the northerly
line of the Hecker Pass Highway and of said Annexation
N.88045IE.188.01 feet, more or less, to the southeasterly
corner of that certain 45.61 acre parcel of land described
in the deed from Harry G. Pappani and Katherine Pappani,
his wife, to Felix A. Pappani, et al, recorded May 28,
1951, under Recorder's File No. 721722 in the Office of
the Recorder of Santa Clara County; thence along the
easterly line of said 45.61 acre parcel N.4059'E.1632.26
feet to the northeasterly corner thereof; thence along
the northerly line thereof and the westerly prolongation
thereof B~89006IW.1222.15 feet, more or less, to the
intersection thereof with the line common to the Solis
and Las Animas Ranchos, being also the centerline of
Morey Avenue; thence along said last mentioned line.
S. 4059IW.1755.60 feet, more or less, to the point of
beginning, and CONTAINING THEREIN 74.586 acres.
3. That said petition contains the written consent of all
of the petitioners to the annexation.
4. That a notice of intention to annex the said premises
has been filed with the Local Agency Formation Commission, pursuant
to Section 54794 of the Government Code, and said Local Agency
Formation Commission of Santa Clara County has fixed the date, time
and place for a public hearing upon the proposed annexation, given
the notice that is required by Section 54796 of the Government Code,
has held the said hearing in accordance therewith, made its deter-
mination upon the proposed annexation and has approved said
annexation as proposed.
5. That Monday, the 2nd day of May, 1966, at the hour of
8:00 o'clock, p.m., in the Council Chambers in the City Hall at

No. 10 South Rosanna Street, in the city of Gilroy, County of
Santa Clara, California, is hereby fixed as the time and place
when and where any person owning real property within the City
of Gilroy who does not also own real property in the territory
proposed to be annexed and having objections to the proposed
annexation may appear before the Council of the City of Gilroy
and show cause why.such uninhabited territory should not be so
annexed to the City of Gilroy. The protest must be in writing,
may be filed at any time before the hour set for hearing objec-
tions to the proposed annexation, and shall state the name or
names of the owner or owners of property affected and the des-
cription and area of such property, in general terms.
6. The City Clerk of the City of Gilroy is hereby authorized
and directed to cause a copy of this resolution to be published
at least once in the Gilroy Evening Dispatch, a newspaper of
general circulation published in said City of Gilroy, the city
to which it is proposed to annex the aforesaid territory, in the
County of Santa Clara, California, the county in which is located
the territory proposed to be annexed to the City of Gilroy, said
publication to be complete at least four (4) days prior to the
date set for hearing.
7. The City Clerk is directed to cause written notice to
be given to such other persons as may be legally entitled thereto,
in the manner required by law.
