RESOLUTION NO. 1026
A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS PURSUANT
TO SPECIAL ASSESSMENT AND ASSESSMENT BOND ACTS FOR THE
ACQUISITION AND CONSTRUCTION OF IMPROVEMENTS WITHOUT PRO-
CEEDINGS UNDER DIVISION 4 OF THE STREETS AND HIGHWAYS CODE
NORTH CHURCH STREET EXTENSION
PROJECT NO. 1966-1
RESOLVED, by the City Council of the City of Gilroy,
California, that
WHEREAS, all of the owners of more than 60% in area of the
property subject to assessment therefor have signed and filed with
the City Clerk of this City a written petition for undertaking
proceedings pursuant to special assessment and assessment bond
acts, and to assess the costs thereof upon the properties benefite
by said improvements, and waiving proceedings under Division 4
of the Streets and Highways Code, for the following acquisitions
and improvements:
(a) The acquisition of property necessary for the
opening of a new street to be known as Church Street
from the intersection of Carlyle Avenue and Ronan Avenue
running thence southerly and southeasterly to Welburn
Avenue at its intersection with Church Street, as it
now exists, and a new street to be known as Pierce
Street in and along that certain private road known as
Pierce Street from its intersection with said new street
to be known as Church Street, running thence easterly
330 feet, more or less, and the improvement thereof by
clearing, grubbing, grading and the removal of existing
trees, shrubs and structures and the construction there-
in of base, pavement, curbs, gutters, sidewalks, where
required, surface and subsurface storm drainage facili-
ties, where necessary, sanitary sewer mains, standard
manholes with standard manhole frames and covers, wye
branches, laterals, where necessary, water mains, valves,
tees, crosses, services, where necessary, and fire hydrants,
together with the connection of said sewer and water facili-
ties to existing facilities of the City of Gilroy.
(b) The acquisition of all lands and easements and
the performing of all work auxiliary to any of the above
necessary to complete the same.
WHEREAS, the costs and expenses of said contemplated acqui-
sitions and improvements are to be chargeable upon an assessment
district, the exterior boundaries of which are the coterminous
exterior boundaries of the composite and consolidated area shown

on the map thereof on file in the office of the City Clerk to
which reference is hereby made for further particulars;
WHEREAS, the public interest and convenience will be served
by the taking of said proceedings;
NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED and ORDERED
that all of the owners of more than 60% in area of the property
subject to assessment for said proposed acquisitions and improve-
ments have filed with the City Clerk of this City a written
petition for the construction of improvements pursuant to appro-
priate special assessment and assessment bond acts, without
. further compliance with the provisions of Division 4 of the Streets
and Highways Code.
