Resolution 1068 '11" t ,~'~ - ..... 1Lt ~~,~ _1"1 RESOLUTION NO. 1068 RESOLUTION OF INTENTION TO VACATE ALL THAT PART OF MAPLE STREET IN THE CITY OF GILROY LYING BETWEEN OLD GILROY STREET AND EIGHTH STREET WHEREAS, Maple street in the City of Gilroy, is one of the public streets in said city and that portion thereof lying between Old Gilroy street and Eighth Street is unnecessary for present or prospective public street purposes and shoull be vacatedi NOW THEREFORE, BE IT RESOLVED By the Council of the City of Gilroy that it does hereby declare its intention to vacate all that portion of Maple Street in said City of Gilroy lying between Old Gilroy Street and 8th Street, and that in the vacation of said portion of said street, the City of Gilroy shall and does hereby reserve and except the permanent easement and right at any time or from time to time, to construct, maintain, operate, replace, remove and renew sanitary and ot1er sewers and drain and water pipe lines and storm drains in, upon, over and across the part of said street proposed to be vacated, and pursuant to any franchise thereof or renewals thereof or otherwise, to construct, operate, main- tain, replace, remove, renew and enlarge lines of pipes, conduits, cables, wires, poles and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, and for the transportation or distribution of electrical en~rgy and water. BE IT FURTHER RESOLVED That this Resolution shall be published and said street posted as required in the Street Vacation Act of 1941, under which this proceeding is instituted, and the 3rd day of January, 1967, at 8:00 o'clock p.m., in the Council Chambers, City Hall, No. 10 South Rosanna Street, 10b8 Gilroy, California, is hereby designated as the time and place at which said City Council shall hear any and all persons interested in or who may object to the proposed vacation. One publication of said notice shall be made in the Gilroy Evening Dispatch, a newspaper published in the City of Gilroy, at a date at least ten (10) days prior to the time of hearing. ADOPTED AND PASSED This 5th day of December, 1966, by the following vote: AYES: COUNCILMEN: Allemand, Duffin, Eckard, Goodrich, Quartiroli, Wentworth and Petersen.
