RESOLUTION NO. 977
BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY RELATIVE
TO EXTENSION OF MUTUAL AID UNDER MASTER MUTUAL AID AGREEMENT IN CASES
OF LOCAL PERIL OR EMERGENCY.
WHEREAS, City of Gilroy is one of the parties to that certain
Master Mutual Aid Agreement signed by the County of Santa Clara and all
cities and fire districts in said county, and
WHEREAS, said Agreement specified that each of the parties to
said Agreement will extend mutual aid under said Agreement in all cases
of local peril or emergency; and
WHEREAS, it is well understood and recognized that serious
conditions of local peril and emergency exist and are compounded if and
when confusion arises as to which governmental agency has proper juris-
diction to render aid to persons facing fire, or other calamity; and
WHEREAS, the City Council of the City of Gilroy desires by this
resolution to extend the Master Mutual Aid Agreement, and such operation-
al plans adopted pursuant thereto to all such above-described situations
of individual peril or emergency;
NOW, THEREFORE, BE IT RESOLVED that the City of Gilroy finds
and determines that a local peril or emergency may exist within the
meaning of the Master Mutual Aid Agreement signed by all parties thereto
solely because of the fact that the availability aid from the agency
having proper jurisdiction over the persons or property endangered may
be further removed from the scene of such damage than available aid
under the jurisdiction of some other political agency that is a party
of said Master Mutual Aid Agreement;

AND BE IT FURTHER RESOLVED that the City of Gilroy, does hereby
find and declare that those departments and agencies under its j,urisdic-
tion which are established to render at least police, fire and other like
protection to persons and property, are directed to respond to emergency
calls upon request by the agency determining need for such aid without
regard to the political jurisdiction in which the individual person or
property in peril may be situated, if and when such department or agency
determines that it is the closest department or agency available for
rendering such needed aid, or there is doubt as to whicn agency has juris-
diction, and that serious personal injuries or death or substantial prop-
erty damage may result unless such aid is made immediately available.
