RESOLUTION NO. 808
RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY
ACC.EPTING IMPROVEMENTS MADE, EXCLUS IVE OF PLANTING
OF TREES, MADE BY THE DEVELOPERS OF WESTWOOD ACRES,
UNIT NO. 1
WHEREAS, KENTWooD DEVELOPMENT CO., INC., a corporation,
has heretofore subdivided a tract of land in the City of Gilroy
designated as WESTWOOD ACRES l1N'I'r NO.1, TRACT NO. 3500, and
in order to secure the acceptance and approval of the said City
of Gilroy of the official map of said subdivision, the said
KENTWOOD DEVELOPMENT CO., INC., a corporation, did enter into
an Agreement on the ~ day of May, 1963, with the City of
Gilroy in which it agreed to cause to be constructed, installed
and completed, certain improvements consisting of streets, high-
ways or public ways, and sewer facilities, curbs, sidewalks and
gutters, catch basins, sewer lines and water pipe lines, culverts,
onsite and offsite storm drains, sanitary sewers, street
lighting, street signs, fire hydrants, fire alarm boxes, trees,
and other improvements in accordance with and as required by
plans and specifications for said improvements and conforming
to certain standards which were then on file in the office of
the Clerk of the City of Gilroy and did give a bond in the sum
of $258,080.00, to secure the performance of the said work and
the proper installation of the said facilities; and
WHEREAS, the Director of Public Works of the City of
Gilroy has reported to the said Council of the said City of Gilroy,
that all of the said facilities and improvements and utilities
have been furnished and installed by the said KENTWOOD DEVELOPMENT
CO., INC., in accordance with the said Agreement, excepting the
planting of trees, and that the facilities and improvements already
furnished to the City of Gilroy are acceptable to the City of
Gilroy and that the said bond of said KENTWOOD DEVELOPMENT CO.,
INC., should be reduced to the sum of $5,000.00, which bond,
as reduced, shall remain in effect for one year from and after

the acceptance of said improvements to secure the repairing
of any defects which may appear in any of said work within said
time, and the furnishing and planting of said trees.
NOW THEREFORE BE IT RESOLVED that the said City of Gilroy
does hereby accept the said improvements, utilities and facilities
as installed by the said KENTWOOD DEVELOPMENT co., INC'r under
the aforesaid Agreement as complying with and as being in full
performance of the said contract, excepting the furnishing and
planting of trees, and subject to the repair of such defects as
may be disclosed therein during the period of one year from and
after this acceptance of said facilities, utilities and improve-
ments and that the bond heretofore furnished by the KENTWOOD
DEVELOPMENT CO'r INC. [ to secure the faithful performance of
said Agreement, be reduced to the sum of $5,000.00 to remain in
effect and be effective for the said period of one year and
thereafter until any defects in the said facilities and
improvements and utilities which are disclosed within said
period of one year are repaired by the said KENTWOOD DEVELOPMENT
CO.r INC.r and said trees are furnished and planted, and further
that the said Surety on said bond be exonerated as to all of the
remaining portion of said bond.
PASSED AND ADOPTED this 2nd day of March, 1964, by the
