RESOLUTION OF COUNCIL OF THE CITY OF GILROY
ACCEPTING IMPROVEMENTS MADEl EXCLUSIVE OF PLANTING
OF TREES, MADE BY THE DEVELOPERS OF LAS ANIMAS
ESTATES, UNIT NO.3, TRACT NO. 3583
WHEREAS, DONALD L. STONE, an individual doing business as
the DONALD L. STONE ORGANIZATION, has heretofore subdivided a
tract of land in the City of Gilroy designated as LAS ANTIMAS
ESTATES, UNIT NO.3, TRACT NO. 3583, and in order to secure
the acceptance and approval by the said City of the Official
Map of said subdivision, the said DONALD L. STONE ORGANIZATION
did enter into an Agreement on the ~ day of December, 1963,
with the City of Gilroy, in which it agreed to cause to be
constructed, installed and completed, certain improvements
consisting of streets, highways or public ways and sewer facili-
ties, curbs, sidewalks and gutters, catch basins, sewer lines
and water pipe lines, culverts, onsite and offsite storm drains,
sanitary sewers, street lighting, street signs, fire hydrants,
fire alarm boxes and trees in accordance with and as required
by plans and specifications for said improvements and conforming
to certain standards which were then on file in the office of
the Clerk of the City of Gilroy and did giJe a bond in the sum
of $5,000.00 to secure the performance of the said work and the
proper installation of the said facilities; and
WHEREAS, the Director of Public Works of the City of Gilroy
has reported to the said Council of the said City of Gilroy, that
all of the said facilities and improvements and utilities have
been furnished and installed by the said DONALD L. STONE ORGANI-
ZATION, in accordance with the said Agreement, excepting the
planting of trees, and that the facilities and improvements
already furnished are acceptable to the City of Gilroy, subject
to the repairing of any defects which may appear in any of the
said work within the time of one year from and after the adoption

of this resolution;
NOW THEREFORE BE IT RESOLVED that the said city of Gilroy
does hereby accept the said improvements, utilities, and facili-
ties as furnished and installed by the said DONALD L. STONE
ORGANIZATION, under the aforesaid agreement, as complied with and
as being in full perf o LlTIanCe of the said Agreement, with the
exception of the furnishing and planting of said trees, said
acceptance being also subject to the repair of such defects as
may appear therein during the period of one year from and after
this acceptance. The said bond in the sum of $5,000.00 shall
remain in effect and be effective for the said period of one year
and thereafter until any defects in the said facilities, improve-
ments, and utilities which are disclosed within said period are
repaired, and said trees are furnished and planted by the said
DONALD L. STONE ORGANIZATION.
PASSED AND ADOPTED this 2nd day of March, 1964, by the
following vote:
