Resolution 830 RESOLUTION NO. 830 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY INSTRUCTING THE D[RECTOR OF PUBLIC WORKS TO ABATE NUISANCE AR[SING OUT OF WEEDS GROWING UPON LOTS OR IN FRONT OF PROPERTY IN THE CITY OF GILROY AS REQUIRED BY SECTION 6 OF ORDINANCE 635. WHEREAS, the Council did, on the 1st day of June, 1964, adopt Rasolution No. 828 declaring certain weeds growing in the City of Gilroy to be a public nuisance, describing weeds which constitute such nuisance, and providing for the giving of notice of the adoption of the Resolution by publ ication there- of in accordance with Ordinance No. 635 of the City of Gi Iroy, noW Section 12.35 of the Gi Iroy City Code providing for the abatement of weeds which constitute a nuisance; and, WHEREAS, the said Resolution complied with Section 2 of said Ord- inance No. 635 and said Resolution was duly published for two (2) successive days in the Gilroy Evening Dispatch, the dates of publication being June 2nd and 3rd, 1964; and WHEREAS, after the passage of the foregoing Resolution the Director of Public Works caused a notice to be conspicuously posted on or in front of or within fifty (50) feet of any lot, piece, or parcel of land on which or in front of which such weeds constituting a nuisance existed; and, where two (2) or more lots, pieces or parcels of land on which or in front of which such nuisance existed were contiguous such notice was posted thereon or in front thereof and not more than fifty (50) feet or less than twenty-five (25) feet apart, which notices were in the form set forth in Sect~on No.3 of said Ordinance No. 635 and provided that property owners having any objections or protest to the pro- posed removal of such weeds should attend a meeting of the City Council to be held in the Council Chambers, City Hall, 10 South Rosanna Street on the 15th day of June, 1964, at the hour of 8:00 o'clock, any such objections to be heard and be given due consideration; and, -1- gJC WHEREAS, the said notices were posted at least five (5) days prior to the said 15th day of June, 1964, the date fixed for hearing objections, and, WHEREAS, the said Council has now proceeded to hear said objections or protests, if any, to the said weed abatement and no one appearing before this session of the Council to protest or object to said weed abatement proposed; BE IT THEREFORE RESOLVED, and it is hereby ordered, that the Director of Public Works abate such nuisance by having the weeds referred to in said Resolution No. 828 and in the said notice hereinbefore referred to removed, in accordance with the provisions of said Ordinance No. 635, which provisions are set forth in Section 12.39 of the Gilroy City Code.
