"", ''''':'"",',''!,,;,..:'Wf,'''''''~~~ . .. ~.. ..."" ~ // }"';'~.t~!~~1~ . ,Y vJHJM: EA i,iJ: ea 6/15/61]. 15 c · RESOLUTION NO. 836 A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS PURSUANT TO SPECIAL ASSESSMENT AND ASSESSMENT BOND ACTS FOR THE CONSTRUCTION OF IMPROVE~mNTS WITHOUT PROCEEDINGS UNDER DIVISION 4 OF THE STREETS AND HIGH1tJAYS CODE PARKING DISTRICT NO. 1 PROJECT NO. 64-1 RESOLVED, by the City Council of the City .:>f Gilroy, California, that WHEREAS, owners of the property subject to assessment therefor have signed and filed with the Clerk of this City a written petition f:>r undertaking proceedings pursuant to special assessment and assessment bond acts, and t:> assess the costs thereof upon the propertles benefited by said improvements, and waiving proceedings under Division 4 of the Streets and Highways Code, for the f:>llowing: The acquisition of the following Parking Sites: "A" on the east side of Monterey Street north of Martin Street; "B" on the east side of Monterey Street and on the north side of Sixth Street; "c" on the east side of Eigleberry Street midway between Fourth Street and Fifth Street; "D" on the east side of Eigleberry Street midway between Fourth Street and Fifth Street; and liE" on the east side of Eigleberry Street south of Sixth Street; and improving same with demolition, clearing, grading, pavement, curbs, driveway approaches; drains, lighting and appurtenances. vJHEREAS, the costs and expenses of said contemplated ac- quisitions and improvements are t:> be chargeable upon an assessment district bounded n:>rth by Fourth Street and Lewis Street, east by the alley east of Monterey Street, south by Seventh Street and Old Gilroy Road, and west by the alley west of Eigleberry Street. NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED and ORDERED that owners of the property subject t:> assessment for said proposed acquisitions and imprJvements have filed with the Clerk of this City a written petitiJn for the construction of imprJvements pur- suant t:> appropriate special assessment and assessment bond acts, without further compliance with the provisions of Division 4 of the Streets and Highways Code. IT IS FURTHER FOUND, DETERMINED and ORDERED that said pro- ceedings for the construction of said improvements shall be had pursuant to Articles 1 and 4 of Chapter 5, and the bonds shall be issued pursuant to Article 5 of Chapter 6, of the Gilroy Improve- ment Procedure Code.
