RESOLUTION NO. 837
A RESOLUTION OF PRELIMINARY DETERMINATION AND
OF INTENTION TO ACQUIRE AND IMPROVE OFF-STREET
PARKING PLACES AND TO FORM
PARKING DISTRICT NO. 1
PROJECT NO. 64-1
RESOLVED, by the City Council of the City of Gilroy, California,
that it does hereby preliminarily determine that the public interest,
convenience and necessity require, and that it intends to order the
following acquisitions and improvements to be had and done and the
following parking district to be formed, to wit:
1. (a) The acquisition of the following parcels of land:
PARCEL A The North 60 feet of the South 120 feet
of the Block bounded North by Lewis Street, East by an alley, South
by Martin Street and West by Monterey Street.
PARCEL B The North 35 feet 0f the South 80 feet of
the Block bounded North by Martin Street, East by an alley, South by
Sixth Street and West by Monterey Street.
PARCEL C The North 125 feet of the South 290 feet of
the Block bounded North by Fourth Street, East by an alley, South by
Fifth Street and West by Eigleberry Street.
PARCEL D The South 110 feet of the North 220 feet of
the Block b0unded North by Fifth Street, East by an alley, South by
Sixth Street and West by Eigleberry Street.
PARCEL E The South 60 feet of the North 185 feet,
the South 6.5 feet of the East 48 feet of the North 125 feet, and the
South 15 feet of the North 200 feet excepting the West 100 feet, of the
Block bounded North by Sixth Street; East by an alley, South by Seventh
Street and West by Eigleberry Street.
(b) The impr0ving of said parcels by clearing, demolition,
excavation; grading, pavement; curbs, driveways, lighting and drainage
facilities and paint striping.
(c) The making of all acquisitions and the doing of all
work auxiliary to any of the above or necessary or useful in completing
said parcels for public vehicle parking places.
2. All of said work and improvements are to be constructed
at the places and in the particular locations, of the f0rms, sizes,
dimensions and materials, and at the lines, grades and elevations,

as shown and delineated upon the plans~ pr0files and specifications
to be made therefor, as hereinafter provided.
3. There is to be excepted from the w0rlc above described
any of such work already done to line and grade and marked
excepted 0r shown not to be done on said plans) profiles and spec-
ifications.
4. Said Council does hereby adopt and establish as the
official grades f0r said w0rk the grades and elevations to be shown
upon said plans, profiles and specificati0ns. All such grades and
elevations are to be in feet and decimals thereof with reference to
the datum plane of the City of Gilroy.
5. Notice is hereby given of the fact that in many cases
said work and improvement will bring the finished w0rk to a grade
different from that formerly existing, and that to said extent said
grades are hereby changed and that said work will be done to said
changed grades.
6. The costs of said contemplated acquisitions and improve-
ments, in the opinion of the City Council of said City are of more
than local or ordinary public benefit, and said Council does hereb~
make the costs and expenses thereof chargeable upon an assessment
district~ which district said Council declares to be the district
benefited by said improvements and to be assessed to pay the costs
and expenses thereof, the exterior b0undaries of which are more
particularly described as follows:
Commencing at the point of intersection of the s0uth
line of Lewis Street with the west line of the alley along
the S. P. Railway right-of-way~ thence south along the west
line of said alley to its intersection with the north line of
Old Gilroy Street; thence westerly along the north line of
Old Gilroy Street and its westerly projection to the west
line of Monterey Street; thence south along the west line of
Monterey Street to the north line of Seventh Street; thence
west along the north line of Monterey Street to the rear lot
line of the lots abutting on the west side of Eigleberry
Street; thence north along the rear line of said lots on
the west line of Eigleberry Street to the south line of Fourth
Street; thence north along the s0uth side 0f Fourth Street to

the west side of Monterey Street; thence sJuth along the
west line of Monterey street to the westerly projection of
the south line of Lewis Street; thence nJrth along said line
of Lewis Street and its said pr0jection to the point of
c0mmencement.
7. Said City Council further declares that all public
streets~ highways and 0ther public property within said assessment
district, in use in the performance of a public function as such~
shall be omitted from the assessment hereafter to be made to cover
the C0StS and expenses of said improvements.
8. N0tice is hereby given that serial bonds to represent
unpaid assessments, and bear interest at the rate of n0t to exceed
six per cent (6%) per annum~ will be issued hereunder pursuant to
Bond Plan D (ad valorem land bJnds), Article 5~ Chapter 6~ of the
Gilroy Improvement Procedure Code, the last installment of which
bonds shall mature not to exceed thirty-nine (39) years from the
second day of July next succeeding ten months from their date.
9. Except as herein otherwise provided for the issuance
of bonds and f0r the f0rmation of a parking district~ all of said
work shall be done as provided in Articles 1 and 4~ Chapter 5, of
said Code.
10. A parking improvement and maintenance district will be
formed for the purpose of paying the costs and expenses of acquir-
ing, constructing~ reconstructing, installing, extending, enlarging,
repairing, improving, maintaining and operating public automobile
parking places therein by the City, the exterior boundaries of
which shall be coterminous with the exterior boundaries of the
assessment district above described, to be known as "City of Gilroy
Parking District No. lll~ pursuant to Chapter 5~ Article 5 of said
Code.
11. Said improvements are hereby referred to the City
Engineer of said City, as the officer having charge and c0ntrol of
the construction of public improvements in and for said City 0f

the kind described herein, being a c'.)mpetent person employed by
said City f~r that purpJse, and said City Engineer is hereby
directed to make and file with the Clerk of said City a report
in writing, presenting the f011owing:
(a) Maps and descriptions of off-street parking sites
to be acquired pursuant tJ this Resolution;
(b) Plans and specifications 0f the proposed improve-
ments to be made pursuant to this Resolution;
(c) Engineer's estimate of the total estimated cost
and expenses of said improvements and of the incidental expenses
in connection therewith;
(d) A map having delineated thereon the boundaries of
the assessment district and parking maintenance district.
12. If any excess shall be realized from the assessment it
shall be spent for the maintenance of said improvements unless the
Council shall hereafter determine that said amount or any part
thereof shall be applied as a credit upon assessments to be levied
to service such b0nds, in which event it shall be credited against
the next accruing installments thereof.

I hereby certify that the foregoing is a full, true and

and adopted by the City Council of the City of Gilroy, California,
at a meeting thereof held 0n the 15th day of June, 1964, by the
