RESOLUTION NO. 720
RESOLUTION OF COUNCIL APPROVING REPORT OF PLANNING COMMISSION AUTHORI-
ZING GRANTING OF VARIANCE TO ROBERT K. BYERS AND WARREN L. BYERS FOR
THE CONSTRUCTION OF AN EXTENSION OF THEIR BUILDING AT MILLER AVENUE,
FIRST STREET AND PRINCEVALLE STREET WHICH WILL ENCROACH UPON SET
BACK LINE OF MILLER AVENUE.
WHEREAS, Robert K. Byers and Warren L. Byers have heretofore filed a
verified petition with the Planning Commission of the City of Gilroy for a
variance authorizing them to construct an addition to their present build-
ing located at First Street between Miller Avenue and Princevalle Street,
so that the same will encroach upon the existing set back line on Miller
Avenue; and
WHEREAS, said Planning Commission after due hearing and notice thereof,
of said petition has made the report to the Council approving the granting
of said variance as requested and said report has now been presented to
the Council for action thereupon and said Council has duly considered
said appl ication and report and has determined that the variance should
be author I zed;
NOW THEREFORE, BE IT RESOLVED and it is hereby ordered that said
report of said Planning Commission upon said application be and the same
is hereby approved and confirmed and that said variance be granted and
the permit therefore issued upon condition that adequate parking be pro-
vided, as required by "SII Zone Ordinance before the additional structure
is occupied.
PASSED AND ADOPTED this 7th day of January, 1963, by the following
vote:
AYES: COUNCIL MEMBERS: Duffin, Goodrich, Jordan, Quartirol i, Went-
worth, and Petersen.
NOES: COUNCIL MEMBERS: None
