RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION TO CI~Y OF
GILROY OF UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIG-
NATED liS IXTH WESTERN ADD I T ION (1- 63) 1:0 THE CITY OF GILROY"
AND GIVING NoricE OF TIME AND PLACE FOR HEARING OF PROTESTS
THERETO.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GILROY AND IT
DOES HEREBY FIND:
1. That, pursuant to the Provisions of the Annexation of Uninhabited
Territory Act of 1939, a petition signed by the owners of all of the land in
the hereinafter described territo~y, by area and by assessed value as shown
on the last equalized assessment roll of the County of Santa Clara, was filed
with the Council of the City of Gilroy on January 21st, 1963, requesting an-
nexatlon of the hereinafter described territory to said Cityo

City of Gilroy and which said City and its Council propose to annex, is con-
tiguous to the Westerly City Limits and boundary of said City, is hereby desig-
nated "S1XTH WESTERN ADDITION.TO THE CITY OF GILROY", is located in the County
of Santa Clara, State of Cal ifornia and is described as follows:
PARCEL 1
BEGINNING at the point of intersection of the present westerly city limits of
the City of Gilroy with the southerly 1 ine of the Hecker Pass Highway 66 feet
wide, said point being also the easterly line of Lot 6 as shown on the Map of
the "So P. Fine Subdivision" recorded in Book "F-2" of Maps at page 46, Records
of Santa Clara County, California; running thence along the easterly boundary
I ine of said Lot 6 So 10 10' Wo 737.88 feet and S. 150 40' Wo 2976.60 feet to
the most southerly corner of said Lot 6; thence along the southerly line of
Lots 5 and 6 of said liS. P. Fine Subdivision" in a northwesterly direction
409.33 feet to the southwesterly corner of said Lot 5 of said subdivision;
thence N. 40 301 E. along the westerly line of said Lot 5, 3389.76 feet to
the southerly line of the Hecker Pass Highway; thence in an easte~ly direction
along the said southerly line of Hecker Pass Highway 916.89 feet to the point
of beginning; excepting therefrom the following described portion of said
Lo t 5:
"BEGINNING at an iron pipe in the southeasterly line of Hecker
Pass Road (formerly Bodfish Mill Road) at the intersection
thereof with the line common to Lots 4 and 5 as shown on said
Map, and running thence along said southeasterly line N. 880
45' E. 361.25 feet to an iron pipe; thence along a line paral-
lel to the line common to Lots 4 and 5 So 40 30' WO 530.82 feet
to an iron pipe; thence S. 880 45' Wo 361.25 feet to an iron
pipe in the line common to Lots 4 and 5; thence along said
common line No 40 30' E. 530.82 feet to the point of beginning,
and containing therein 40380 acre parcel of lando"
Constituting all of the said Lots 5 and 6 of the said "S. Po Fine Subdivisionll

PARCEL 2
All of the Hecker Pass Highway (formerly Bodfish Mill Road), 66 feet in
width extending from the easterly boundary of the above described excep-
tion easterly to the easterly line of Lot 6 in the present corporate limits
of the City of Gilroy.
3. That at the time of fil ing said petition said territory proposed
to be annexed contained and still contains less than twelve (12) registered
voters and it is uninhabited territory as defined in the Annexation of Unin-
habited Territory Act of 1939.
4. That said petition contains the written consent of all of the
owners of the territory proposed to be annexed.
5. The proponents of said annexation have heretofore submitted to
the County Boundary Commission of Santa Clara County, California, the pro-
posal to annex the aforesaid territory to the City of Gilroy, together with
a description of the said territory and a request that said Commission pass
upon and approve the certainty and definiteness of said description, and
said Commission has approved said boundaries.
6. That Monday, the 4th day of March, 1963, at the hour of 8:00
o'clock p.m., In the Council Chambers in the City Hall in the City of Gil-
roy, County of Santa Clara, Cal ifornia, is hereby fixed as the time and
place when and where any person owning real property within the uninhabited
territory above described and proposed to be annexed to the City of Gilroy,
and having objections to the proposed annexation, may appear before the
Council of the City of Gilroy and show cause why such uninhabited territory
should not be so annexed to the City of Gilroy. The protest must be in
writing, may be filed at any time before the hour set for hearing objections
to the proposed annexation, and shall state the name or names of the owner
or owners of property affected and the description and area of such property,
in general terms.
7. The City Clerk of the City of Gilroy is hereby authorized and
directed to cause a copy of this resolution to be published at least twice,
but not oftener than once a week, in the Gilroy Evening Dispatch, a newspaper

of general circulation published in said City of Gilroy, the city to which it
is proposed to annex the aforesaid territory, in the County of Santa Clara,
California, the County in wh~ch is located the territory proposed to be
annexed to the City of Gilroy, said publication to be complete at least
twenty (20) days prior to the date set for hearing.
8. The City Clerk is directed to cause written notice to be given to
such other persons as may be legally entitled thereto, in the manner required
by law.
PASSED AND ADOPTED this 21st day of January, 1963, by the following
