RESOLUTION NO. 740
RESOLUTION OF THE CITY OF GILROY ACCEPTING A ONE-FOOT STRIP
OF IAND ALONG THE SOUTHERLY LINE OF WALNUT AVENUE IN WALNUT
ORCHARD PARK TRACT NUMBER 1051 A SUBDIVISION IN THE CITY OF
GILROY RESERVED FOR FUTURE PUBLIC ROAD ON THE OFFICIAL MAP
OF SAID SUBDIVISION UNTIL THE SAME IS ACCEPTED BY THE CITY
OF GILROY.
WHEREAS, there was dedicated by the owners and developers
of Walnut Park Tract Number 1051 a Subdivision in the City of
Gilroy for public use a strip of land designated and reserved for
future public road along the southerly line of Walnut Avenue as
shown on said map stated in said dedication to be reserved
exclusively for the owners of lots in said Subdivision until an
additional strip of land adjoining it for extension or a widening
of said Avenue is accepted by the Board of Supervisors of the
County of Santa Clara; and,
WHEREAS, the said one-foot strip of land so dedicated and
reserved is in reality a part or should be a part of Walnut Avenue
and the additional strip of land adjoining it is not required by
the City of Gilroy for any useful purpose and the said City does
not contemplate widening the said Walnut Avenue; and,
WHEREAS, the reference in the said dedication to the Board of
Supervisors of the County of Santa Clara was an error and it was
intended to designate the City of Gilroy in said County as the agency
to accept the said strip of lan~and,
WHEREAS, the said one-foot strip of land dedicated for public
use reserved in the said certificate forming a part of the official
map of said Subdivision was never accepted by the City of Gilroy but
should be accepted by said City so that the same will officially
form a part of Walnut Avenue;
NOW, THEREFORE BE IT RESOLVED, by the Council of the City of
Gilroy that the City of Gilroy does hereby accept the said one-foot
strip of land designated as reserved for future public road on the
aforesaid map;

BE IT FURTHER RESOLVED, that the City of Gilroy does not require
the additional one-foot strip of land described in the owners certi-
ficate which contains the aforesaid dedication; and that the City
of Gilroy has no intention of widening the said Walnut Avenue at
the said point where said strip of land is located.
