RESOLUTION DETERMINING THAT PROTESTS AGAINST PROPOSED
ANNEXATION OF TERRITORY IN "FIFTH NORTHERN ADDITlON"
ARE INSUFFICIENT
WHEREAS, proceedings are not pending before the Council of the City of
Gilroy for the annexation of inhabited territory designated as "Fifth Northern
Addition" under the Annexation Act of 1913, and the preliminary steps have
been taken and completed as required by said act up to and including the
adoption and publication of the resolution required by Section 35116 of the
Government Code in which resolution the 25th day of March, 1963, at 8:00 P.Mo
was fixed as the time for hearing protests against said annexation; and
WHEREAS, the said hearing was held at the time and place specified in the
said resolution and at said time a majority protest had not been made and the
hearing was duly recessed until the 4th day of April, 1963, at the hour of
8:00 PoM. at the regular meeting place of the Council in the City Hall, No.
10 South Rosanna Street, Gilroy, Cal ifornia, at which time all the protests
which had been filed up to that hour were found to be as follows:

WHEREAS, at a time not later than the hour set by said resolution for
hearing objections to the proposed election and at a time not later than the
hour to which the Council recessed the hearing as required by Section 35120 of
the Government Code, protests were not made by the owners or by public and
private owners of land in the territory proposed to be annexed, the assessed
value of which equal led or exceeded the assessed value of all land in the
said territory; and
WHEREAS, it appears that the total assessed value of all land in the
territory proposed to be annexed as shown on the last equalized assessment
roll is the sum of $ 44,870.00
, and that the assessed value of all the
land in the territory of owners protesting said annexation is the sum of
$
13,890.00
, and that said protests are not sufficient to constitute a
majority protest against annexation;
NOW, THEREFORE, be it resolved and it is hereby found, that a majority
protest against said annexation has not been made and that the Council elects
to proceed with the said annexation and call a special election without delay
and submit to the electors residing in the territory the question of whether
it shall be annexed to the City of Gilroy in accordance with the provisions
of Section 35122 of the Government Code.
