Resolution 756 RESOLUTION NO. 756 RESOLUTION REQUESTING A REHEARING BEFORE THE INTERSTATE COMlfffiRCE COMMISSION ON THE APPLI- CATION FOR ABANDONMENT BY THE SOUTHERN PACIFIC COMPANY OF A PORTION OF ITS VASONA LINE BRANCH WHEREAS, on the 13th day of March, 1963, the Interstate Commerce Commission, in Finance Docket No. 22009, denied the applicatbn of the Southern Pacific Company to abandon a portion of its Vasona Branch Line of railroad in Santa Clara County; and WHEREAS, said decision denying the right to abandon said line will seriously disrupt the Expressway Program of the County of Santa Clara in that the Foothill Expressway was planned to be constructed over the right of way of railroad line sought to be abandoned; and WHEREAS, if said decision is allowed to stand, the increased costs of the Foothill Expressway will be so great and insur- mountable that this portion of the Expressway Program will likely have to be abandoned; and WHEREAS, it is necessary and essential to the future develop- ment of the County of Santa Clara that the Foothill Expressway be constructed as originally planned; and WHEREAS, this City is a member of the Trafficways Committee, and has endorsed and supported the Expressway Program that has been approved by the voters of Santa Clara County; and WHEREAS, this City would like to go on record before the Interstate Commerce Commission of requesting that a rehearing be granted and that upon rehearing the application of the Southern Pacific Company be approved as originally requested. NOW, THEREFORE, IT IS HEREBY RESOLVED, that a certified copy of this Resolution be filed with Mr. Harold D. McCoy, Secretary of the Interstate Commerce Commission, Washington 25, D.C., in order that it be a matter of record that this City Council requests a rehearing in the application of the Southern 7% Pacific Company for its abandonment of a portion of its Vasona Line Branch, and further that this City Council hereby requests that the Interstate Commerce Commission reverse its decision to allow the abandonment as requested.
