RESOLUTION NO. 758
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
ESTABLISHING A NEW STORM DRAIN FUND TO BE KNOWN AS
"STORM DRAIN FUND "E".
WHEREAS, The Council has heretofore adopted ordinances and
resolutions requiring the payment of fees to the City of Gilroy
by the developers of real property to provide a fund to be used
by said City in connection with the construction and installation
of off-site storm drainage facilities; and has heretofore by
Resolution No. 610 established or created four funds to be known
as off-site storm drain funds "A", "B", "c" and "D" with each
of said funds applying to specific areas as described in the
resolutions of the Council; and,
WHEREAS, the said Council did, by Resolution No. 752, adopted
on the 6th day of May, 1963, amend the Drainage Element of the
General Plan by adding an off-site storm drain element to be known
as Zone "E" which Zone "E" comprises the following described
territory located in the County of Santa Clara, State of California,
to-wit: All of Lots 2, 3, 4, 5, and 6 as shown on the map entitled
ItMap of a Subdivision of the Lands of S. P. Fine in the Solis Rancho,
Santa Clara County, California", which is recorded in Book "F-2" of
Maps at page 46, records of Santa Clara County, and containing 146.43
acres, more or less; and,
WHEREAS, it was the intention of the Council in establishing
said Zone "E" Element of the General Plan that funds be collected
from the developer or developers of the property in the territory
comprising said Zone "E" to pay certain fees, the amount of which
is determined by the standards and requirements and policies already
adopted by the Council, and it is necessary that a new or additional
fund to be known as Storm Drain Fund "E" be created, in which the
fees collected in said Zone "E" be placed and be used for the purposE
of off-site storm drainage of the area.

NOW, THEREFORE, BE IT RESOLVED that there shall be and is hereby
established a fund to be known as Off-site Storm Drain Fund "E" in
which the fees collected for off-site storm drainage from developers
of property in the said district comprising Drainage Element Zone "E"
of the Master Plan be placed for use in providing drainage required
by or connected with the said Zone Territory and all fees collected
from the developers of said area for off-site storm drainage shall
be placed in said fund and used for said purposes.
