Resolution 759 RESOLUTION NO. 759 RESOlunON OF COUNCIL OF THE CiTY OF GlLROY DECLARING CERTAIN WEEDS GROWING IN THE CITY OF GILROY TO BE A PUBLIC NUISANCE, DESCRIBING WEEDS WHICH CONSTITUTE SUCH NUISANCE, AND PROVID- ING FOR G[VING NOTICE OF THE ADOPTION OF THE RESOLUTION BY PUBLICATION THEREOF. WHEREAS, the Council of the City of Gil(oy did heretofore adopt Ordinance No. 635 providing that the Council may declare certain weeds growing upon the streets or sidewalks or upon or in front of private property within the City which bear seeds of the wingy or downy nature or attain such a large growth as to become a fire menace when dry or which are otherwise noxious or dangerous, to be a public nuisance and providing for the abatement of such nuisance, and, WHEREAS, the said Council has determined that there are growing in the City of Gilroy upon streets and sidewalks and upon and in front of private property within the city, weeds of the above type consisting of those known as "wild oats, fox-tail, rip-gut, dog fennel, puncture vine, thistle" and other weeds of a simlliar kJnd or type which, if allowed to attain a growth of four (4) inches or more in height may become a fire menace when dry and are otherwise nox~ous and dangerous and should be declared to be a public nuisance and abated. NOW, THEREFORE, BE I~ RESOLVED that the Council of the City of Gilroy has determined and does hereby determine again that weeds of the description above set forth when and If permitted to attain a growth in height of four (4) inches or more constitute a publ ic nuisance for the reasons above set forth and shall be abated and unless owners or occupants of property upon which said weeds are growing or in front of whose property said weeds grow, abate said nuisance and destroy and remove said weeds, that the City of Gil- roy will destroy the weeds under the provisions of said Ordinance No. 635 at the expense of the property owner; BE IT FUfP"HER RESOLVED, that notice shall be given by the City Clerk of the adoption of this resolution by publication thereof for at least two (2) successive days in the Gilroy Evening Dispatch and that thereafter such proceedings be taken as are required by said Ordinance No. 635 to remove -1- 7!:J~1 any weeds which constitute said nuisance and abate the nuisance caused thereby.
