RESOLUTION AUTHORIZING TRANSFER OF ALL INTEREST OF THE
CITY OF GILROY IN AND TO THE WATERS OF LITTLE ARTHUR
CREEK ARISING OUT OF APPLICATION FOR APPROPRIATION OF
WATER OF SAID CREEK FILED WITH THE STATE WATER RIGHTS
BOARD
WHEREAS, the City of Gilroy has heretofore filed with the
State Water Rights Board an application for the appropriation
of 3,000 water acre feet annually from the Little Arthur Creeku
a tributary of the Uvas Creeku and said application is now
pending before the said Water Rights Boardj and
WHEREAS,since the filing of said application, a survey has
been made of the water requirementsu present and future, of the
city of Gilroyo and the available resources of the Gilroy area,
and said survey has determined that the using of the waters of
said Little Arthur Creek for the purpose of augmenting the water
supply for the City of Gilroy is not practical, and that the said
contemplated water rights should not be perfectedj and
WHEREAS, the South Santa Clara Valley Water Conservation
District is a public corporation, comprising land in the Southern
portion of the County of Santa Clarao including the City of Gilroyo
and has expressed an interest in acquiring rights to the available
water of the said Little Arthur Creek to further the purposes of the
District in increasing the underground supply of water of the
lands in said district, and the utilization of the said water
for the said purpose will be for the benefit of all the lands
in the districto including the City of Gilroy, and the Council
of said City feels that whatever rights the City of Gilroy has
in and to the said waters of the said Creek and the cpplication
for the appropriation of said watersu instead of being abondoned,

should be transferred and assigned to the South Santa Clara
Valley Water Conservation District7
NOW THEREFORE BE IT RESOLVED that the application heretofore
made for the appropriation of water by the City of Gilroy from
the said Little Arthur Creek and all rights of the City of
Gilroy to the waters of said creek arising out of said application
or otherwise deriving to the City of Gilroyu be assigned and
transferred and set over to the said South Santa Clara Valley
Water Conservation District, and that a written assignment of
all said rights to the South Santa Clara Valley Water Conservation
District be executed on behalf of the City of Gilroyu by the
Mayor.
PASSED and ADOPTED this 3rd day of June, 1963, by the
