RESOLUT[ON NO. 770
RESOLUTION OF THE COUNCIL OF THE CITY OF GiLROY CONFIRMING REPORT OF DIRECTOR OF
PUBLIC WORKS SETT[NG FORTH THE DESCRIPTIONS OF PROPERTY, THE OWNERS THEREOF, AND
THE COST OF ABATING THE NU[SANCE CAUSED BY THE GROWl NG OF WEEDS IN THE C lTY OF
GILROY AND PROVIDING THAT SUCH COSTS W[LL CONSTlTUTE SPECIAL ASSESSMENTS AGAINST
THE RESPECTIVE OWNERS OF LAND.
WHEREAS the Council of the City of Gilroy has heretofore ordered cer-
tain weeds constituting a public nuisance in the City of Gilroy to be removed,
pursuant to Sections 12.35 to 12.44 of the Gilroy City Code, and,
WHEREAS the said Council, on the 20th day of May, 1963, adopted Reso-
lution No. 759 designating certain weeds growing in the City of Gilroy to be a
publ ic nuisance and after the passage of said resolution the Director of Public
Works did cause notice thereof to be given in accordance with the provisions of
Section 12.36 of the Gilroy City Code, which notice was in the form provided for
in said Section, and fixed the 3rd day of June, 1963, at the hour of 8:00 o.clock
p.m. in the Council Chambers in the City Hall, as the time and place for hearing
objections or protests to the proposed removal of said weeds, and that said
hearing was held in accordance with said notice and no one appeared to protest
or object to said removal of said weeds; and,
WHEREAS, the Director of Public Works of the City of Gilroy has sub-
mitted to the Council a written report of the proceedings and actions taken in
the abatement of said weeds, which report sets forth that the weeds were abated
or removed by the property owners from all of the parcels of land, in the City
of Gilroy upon or in front of which weeds constituting a nuisance were growing, with
the exception of thirteen (13) parcels and the names of owners of said thirteen
JJ1l parcels, the descriptions thereof and the cost of removal of weeds from such
respective parcels are as follows:

and, WHEREAS, it appears that said Director of Publ ic Works caused an account of
the cost of removing said weeds from each lot a parcel of land affected and that
said account is correct and should be confirmed;
NOW, THEREFORE, BE IT RESOLVED, that the said report of the Director
of Publ ic Works of the said weed abatement, under the resolutions referred to,
is hereby accepted and confirmed; and,
BE iT FURTHER RESOLVED that a copy of this Resolution and of said
Report of Director of Public Works be turned over to the County Assessor and
County Tax Collector which constitute the Assessor and Tax Collector, respectively,
of the City of Gilroy, after the expiration of ten (10) days from the adoption of
this Resolution, pursuant to Section 12.42 of the Gilroy City Code and the amounts
shown on said report as the cost of the removal of the weeds from each of the
respective properties shall be, and constitute a special assessment against the
respective parcels and constitute alien on the property for the amount of such
assessment, respectively, and the said Tax Collector shall add the amount thereof
to the next regular bill for taxes levied against respective lots and parcels of
land for municipal purposes.
PASSED AND ADOPTED the 15th day of July, 1963, by the following vote:
