RESOLUTION NO. 777
RESOLUTION AUTHORIZING THE EXECUTION OF AGREEMENT WITH
CILROY GARBAGE DISPOSAL COMPANY MODIFYING THE PRESENT
CONTRACT AND FRANCHISE UNDER WHICH GARBAGE, REFUSE,
DEBRIS, ETC. WITH THE CITY IS COLLECTED AND DISPOSED OF
WHEREAS, the Gilroy Garbage Disposal Company has been collecting
and disposing of garbage, refuse, rubbish, debris and offal within
the City of Gilroy under a franchise and agreement heretofore
entered into~ and,
WHEREAS, the said Garbage Disposal Company has been billing
its charges for its services directly to the property owner or
occupant or tenant of the premises involved who sometimes fail to
pay the charges, because of which, services rendered by the Garbage
Disposal Company are affected, and in other instances the property
owner, tenant or occupant disposes of the garbage, offal, refuse,
and rubbish himself contrary to the provisions of the Gilroy City
Code and as a result of said failure to pay and the said disposal
of said garbage, etc. by the property owner, occupant or tenant the
effective collection and disposal has been interfered with, with a
resultant deterioration in the protection to the public health,
safety and general welfare~ and,
WHEREAS, it appears to be necessary in order to prevent the
abuses hereinbefore mentioned and others, that a different system
of billing and collecting for the services rendered by the said
garbage collecter be devised and an agreement has been drawn up
and prepared between the City of Gilroy and the said garbage collecter
modifying the present contract existing between the said parties
which, if followed, should result in an improvement in the protection
to the public health, safety and general welfare~ and,
WHEREAS, the said agreement has now been presented to the City
for consideration and approval and the said agreement having been
duly considered by the Council and approved.
IT IS, THEREFORE, RESOLVED AND ORDERED that the said agreement

as presented be entered into as a modification and change of the
present contract existing between the City of Gilroy and the said
Gilroy Garbage Disposal Company and that the said agreement shall
be effective from and after the 1st day of October, 1963, and shall
be executed on behalf of the City by the Mayor of said City.
