RESOLUTION NO. 778
A RESOLUTION APPROVING CONTRACT SUBMITTED BETWEEN THE
CITY OF GILROY AND THE ROMAN CATHOLIC ARCHBISHOP OF
SAN FRANCISCO
WHEREAS, the Council of the City of Gilroy has heretofore
authorized the entering into of an agreement between the said
City and the Roman Catholic Archbishop of San Franciscog a
corporation sole, providing for the acquisition by said City
for use as a site for a fire station of a certain parcel of
land located in the North Easterly corner of the tract recently
purchased from W. B. Stuart by said corporation, in consideration
of the furnishing and installing of certain public improvements
consisting of streets, pavingg water and sewer mains; and
WHEREASg there has now been presented to the said Council
for approval, written agreement between said City and said Roman
Catholic Archbishop of San Francisco covering the aforesaid
acquisition which has already been signed by the said corporation
sole and it appears to the Council that the agreement as
presented to it should be approved with the understanding that
the following two provisions, both advantageous to the said
Corporation, are deemed to be a part thereof:
1. That subdivision C of Section 2 of said agreement shall
include a provision requiring the City to construct and install
curbs and gutters along the South side of the Westerly extension
of WelburnAvenue from the cul-de-sac to the Westerly end of the
corporationts property as it now exists without cost to the
Corporat ion.
2. That the agreement is subject to the right of W. B.
Stuart who sold the property to the corporation to farm the
area where the fire station is to be constructed and the improve-
ments described in the agreement made, until the City requires

the use of the property it is to acquire for the construction
of said fire station.
NOW THEREFOREt BE IT RESOLVED that the said agreement as
submitted be approved with the understanding that said two
provisions hereinabove set forth shall constitute a part of said
agreement, and that the Mayor of said city execute the agreement
on behalf of said City~ and
BE IT FURTHER RESOLVED that a certified copy of this
resolution be given to the said Corporation forthwith.
