Resolution 602 RESOLUTION NO. 602 RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION TO CITY OF GILROY OF UNINHABITED TERRITORY DESCRIBED HEREIN AND DES IGNATED " CASTLEWOOD PARK ANNEXATION UNIT NO.3" AND GIVING NOTICE OF TIME AND PLACE FOR HEARING OF PROTESTS THERETO BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GILROY: 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, a petition signed by owners of not less than one-fourth of the land in the hereinafter described territory, by area and by assessed value as shown on the last equalized assessment roll of the County of Santa Clara, was filed with the Council of the City of Gilroy on February 13, 1961, requesting annexation of the hereinafter described territory to said City. 2. That the territory which the petitioners request be annexed to the City of Gilroy and which said City and its Council propose to annex, is contiguous to the westerly city limits of said city, contained less that 12 registered voters at the time said petition was filed, is hereby designated "CASTLEWOOD PARK ANNEXATION UNIT NO.3", is located in the County of Santa Clara, State of California and is described as follows: BEING ALL OF LAS AN~S RANCHLOT 21 and a portion of Ranchlots 16 and 23 as shown on the Map No.7, accompanying the Report of the Referees in the Las Animas Rancho Partition Suit, Action No. 5536 had in the Superior Court of the State of California, in and for the County of Santa Clara, and being more particularly described as follows: PARCEL I "BEGINNING at the southwesterly corner of Tract No. 2023, "Castlewood Park, Unit No.3", as shown on said Map thereof recorded in Book 90 of Maps at pages 40 and 41, Records of Santa Clara County, being also the southwesterly corner of the "Castlewood Park Annex- ation No.2" to the City of Gilroy as established by Ordinance No. 519 adopted July 6, 1954, said point of beginning being also in the southerly line of that certain 157.788 acre parcel of land described as Parcel 4 in the deed from the San Martin Sales Co., a co-partner- ship, to the San Martin Vineyards Company, a co-partnership, by deed dated May 1, 1953 and recorded May 1, 1953 in Vol. 2627 at page 215, Official Records of Santa Clara County, distant thereon N. 890 lOt 30" w. 520.00 feet from the southeasterly corner thereof in the centerline of Miller Avenue, and running thence from said point of beginning - 1 - ( along the southerly line of said 157.788 aFre parcel of land N. 890 101 30" W. 680.00 feet to the southwesterly corner of the 11. 285 acre parcel of land N. 890 10 I 30" W. 680 feet to the southwesterly corner of the 11.285 acre parcel of land of the Gilroy Elementary School District as described in Certified Copy of the Final Order of Condem- nation filed August 24, 1960 in Vol. 48~6 at page 254, Official Records of Santa Clara County; thence along the westerly line of said 11. 285 acre parcel N c 00 46 I 30" E. 293.17 feet, N. 20 451 20" W. 171.12 feet, N. 90 181 10" W. 165. 37 feet, and N. 150 201 40" W. 234,53 feet to the northwesterly corner thereof; thence along the northerly line thereof S. 890 131 30" E. 146.64 feet; thence con- tinuing along a curve to the left with a radius of 1000.00 feet, through a central angle of 180 321 30" for a distance of 323.76 feet; thence leaving said northerly line and running across said 157.788 acre parcel of land N. 00 461 30" E. 948.14 feet to a point that is 150.00 feet southerly, at right angles, from the northerly line of said 157.788 acre parcel; thence parallel with said northerly line N. 890 081 30" W. 996.36 feet; thence N. 00 46' 30" E. 150.00 feet to a point in said northerly line at the southeasterly corner of the lands of St. Maryls Cemetery, (Roman Catholic Archbishop of San Francisco, a corpor- ation sole), as described in deed from San Martin Sales Co., a co-partnership Recorded June 30, 1959, in Vol 4465 of Official Records at page 299; thence along the northerly line of said 157.788 acre parcel N. 890 081 30" W. 42.00 feet to the southwesterly corner of the 20.76 acre parcel of land conveyed to San Martin Sales Co., a co- partnership, by James A. Sterling, et ux, by deed recorded March 11, 1958 in Vol. 4027 at page 42, Official Records of Santa Clara County; thence continuing along said northerly line N. 840 181 W. 404.30 feet to the southeasterly corner of Ranch10t 21, as shown on said Map No.7 (at 200.15 feet on this course is the southerly common corner of the St. Maryls Cemetery and the Masonic-l.O O.F. Cemetery); thence along the southerly line of Ranch10t 21, N. 890 oot W. 909.48 feet to the southwesterly corner thereof; thence along the westerly line of Ranch10t 21, N. 10 oot E. 737.88 feet to the Northwesterly corner thereof in the Southerly line of the Hecker Pass Highway (formerly Bodfish Mill Road) ; thence along the southerly line of the Hecker Pass Highway S. 890 E. 2763.76 feet, more or less, to the northeasterly corner of that certain 5.00 acre parcel of land conveyed by Bail1age to Clark by Deed recorded in Vol. 32 at page 262, Official Records of Santa Clara County, being also the northwesterly corner of the Fourth Western Addition to the City of Gilroy, as described in Ordinance No. 571 adopted April 21, 1958; thence along the easterly line of said 5.00 acre parcel and the westerly line of said Fourth Western Addition S. 00 461 30" w. (S. 1 W. Deed) 773.00 feet to the southerly common corner of said 5.00 acre parcel and Fourth Western Addition in the northerly line of said 157.788 acre parcel of land; thence along the northerly line of said 157.788 acre parcel of land N. 890 081 30" W. 150.00 feet to the northwesterly corner of Tract No. 1232, "Cast1ewood Park, Unit No.2", as shown on the map thereof recorded in Book 53 of Maps at pages 12 and 13, Records of Santa Clara County, being also the northwesterly corner of "Cast1ewood - 2 - Park Annexation No. 2", to the City of Gilroy as established by Ordinance No. 519 adopted July 6, 1954; thence along the westerly line of said IICastlewood Park Annexation No. 211 and the westerly line of Tract 1232 and 2023 above referred to S. 00 461 3011 W. 2002.27 feet to the point of beginning, and CONTAINING THEREIN 74.029 acres of land, more or less." PARCEL 2 BEING all of the Hecker Pass Highway, 66 feet in width, extending from the Westerly line of Wren Avenue and the westerly line of the Corporate Limits of the City of Gilroy as established in the Las Animas Estates Annex- ation Ordinance No. 533 acopted October 24, 1955, westerly to the intersection with the northerly pro- longation of the westerly line of Ranch Lot 21, and CONTAINING THEREIN 2.486 acres of land, more or less." 3. That the County Boundary Commission of Santa Clara County, California, did in session duly assembled on January 16th I 1961, consider the proposed annexation boundaries of said "CASTLEWOOD PARK ANNEXATION UNIT NO. 311, as above described, and as submitted to said Commission by the proponents of said annexation and has approved said boundaries. 4. That Monday, Apri 1 17th , 1961, at the hour of 8:00 Olclock P. M. in the Council Chambers in the City Hall of the City of Gilroy, County of Santa Clara, California, is'hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Gilroy, and having any objections to the proposed annexation, may appear before the Council of the City of Gilroy and show cause why such uninhabited territory should not be so annexed to the City of Gilroy. The protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected and the description and area of such property, in general terms. 5. The City Clerk of the City of Gilroy is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in Gilroy Evening Dispatch, a newspaper of gener!circulation published in said City - 3 - of Gilroy, the city IDwhich it is proposed to annex the aforesaid territory, and also in Morgan Hill Times, a newspaper of general circulation published outsiJde the City of Gilroy, but in the County of Santa Clara, California, the county in which is located the territory proposed to be annexed to the City of Gilroy, said publi- cation to be complete at least twenty (20) days prior to the date set for hearing. 6. The said City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed was assessed in the last equalized county assessment roll available on the date the above said proceedings were initiated, at the addressed shown on said assessment roll or known to said Clerk and to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable, with said Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 7. In the event any land within the territory proposed to be annexed is owned by a county, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such county, such notice to be given not less than (20) twenty days before the first public hearing on the proposed annexation. 8. In the event there is, upon the land proposed to be annexed to said City, a structural improvement owned, being acquired or leased by a county fire protection district, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation. 9.
