Resolution 691 RESOLUTION NO. 691 RESOLUTION GIVING NOTICE OF PROPOSED ANNEXATION TO CITY OF GILROY OF UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "FIRST EASTERN ADDITION (7-62) TO THE CITY OF GILROY" AND GIVING NOTICE OF TIME AND PLACE FOR HEARING OF PROTESTS THERETO BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GILROY AND IT DOES HEREBY FIND: 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, a petition signed by the owners of all of the land in the hereinafter described territory, by area and by assessed value as shown on the last equalized assessment roll of the County of Santa Clara, was filed with the Council of the City of Gilroy on June 14 , 1962, requesting annexation of the hereinafter described territory to said City. 2. That the territory which the petitioners request be annexed to the City of Gilroy and which said City and its Council propose to annex, is contiguous to the Easterly city limits of said city, contained less than 12 registered voters at the time said petition was filed, and still contains less than 12 registered voters, and is uninhabited territory as defined in the Annexation of Uninhabited Territory Act of 1939, is hereby designated "FIRST EASTERN ADDITION TO THE CITY OF GILROY", is located in the County of Santa Clara, State of California, and is described as follows: BEING a portion of ranch Lots 40 and 42, as shown on Maps No. '7 and 8, accompanying Report of the Commissioners in Henry Miller, et al, vs. Massey Thomas, et al, in the Superior Court of the State of California, in and for the County of Santa Clara, Case Number 5536, and more particularly described as follows: BEGINNING at the point of intersection of the dividing line between Rancho Las Animas and Rancho San Ysidro, with the Northeasterly line of Old Gilroy Road, also known as Pacheco Pass Road, said point of beginning also being the Easternmost corner of that certain 0.640 acre tract of land described in the Deed from Dave C. Hall, et ux, to Joseph E. Lemos, et ux, dated May 27, 1941, recorded July 1, 1941, in Book 1046 Official Records, page 368, Santa Clara County Records, thence from said point of beginning Northwesterly along the said Northeasterly line of Old Gilroy Road for the following courses and distances: North 820 061 West 215.82 feet; thence along an arc of a curve to the I I ,..\ l".J' -1- right, tangent to the preceding course, with a radius of 147.80 feet, through a central angle of 300 36' for an arc distance of 78.24 feet; thence North 510 30' west 688.38 feet and North 560 16' West 9.00 feet to the Westernmost corner of that certain tract of land described in the deed from Agostino Rocchi, et ux, to George C. Ren~, et ux, dated March 13, 1956, recorded March 19, 1956, in Book 3442 Official Records, page 30, Santa Clara County Records, said point being in an angle corner in the Easterly city limits of the City of Gilroy; thence North 380 30' East along the said Easterly city limits in the Northwesterly line of the land so described in the deed to said Renz for a distance of 159 feet, more or less, to the Northernmost corner thereof in the Southwesterly line of that certain 1.055 acre tract of land described in the deed from David C. Hall, a widower, to Charles Vern Smith, dated October 22, 1948, recorded February 23, 1949, in Book 1749 of Official Records, page 178, Santa Clara County Records, said point being the most Easterly point of the JungEastern Addition to the City of Gilroy; thence North 320 05' West along the said Southwesterly line of the 1.055 acre tract, in the present Easterly city limits of the City of Gilroy for a distance of 50.13 feet to the Westernmost corner of said 1.055 acre tract; thence leaving the Easterly city limits of the City of Gilroy North 570 55' East along the Northwesterly line of the said 1.055 acre tract for a distance of 292.65 feet to a point in the said dividing line between Rancho Las Animas and Rancho San Ysidro; thence South 320 05' East along said dividing line for a distance of 963.59 feet to the point of beginning. 3. That said petition contains the written consent of all the petitioners to the annexation. 4. The proponents of said annexation have heretofore submitted to the County Boundary Commission of Santa Clara CountYi California, the proposal to annex the aforesaid territory to the City of Gilroy, together with a description of the said territory, and said Commission has made its report approving the definiteness and certainty of des- cription of the said territory proposed to be annexed. 5. That Monday, the 16th day of July, 1962, at the hour of 8:00 o'clock P. M., in the Council Chambers in the City Hall in the City of Gilroy, County of Santa Clara, California, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Gilroy, and having objections to the proposed -2- annexation, may appear before the Council of the city of Gilroy and show cause why such uninhabited territory should not be so annexed to the City of Gilroy. The protest must be in writing, may be filed at any time before the hour set for hearing objections to the pro- posed annexation, and shall state the name or names of the owner or owners of property affected and the description and area of such pro- perty, in general terms. 6. The City Clerk of the City of Gilroy is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the Gilroy Evening Dispatch, a newspaper of general circulation published in said City of Gilroy, the city to which it is proposed to annex the aforesaid territory, in the County of Santa Clara, California, the county in which is located the territory proposed to be annexed to the City of Gilroy, said publication to be complete at least twenty (20) days prior to the date set for hearing. 7. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law.
