Resolution 711 RESOLUTION NO. 711 A RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY DECLARING ITS INTENTION TO VACATE A SMALL PARCEL OF LAND CONSTITUTING A PORTION OF WELBURN AVENUE, A PUBLIC STREET IN THE CITY OF GILROY. WHEREAS, the following described premises constitute a portion of Welburn Avenue a public street in the City of Gilroy, to wit: BEING a portion of Welburn Avenue as shown on map entitled "Tract No. 1784, Sherwood Park, Unit No.1", which map is recorded in Book 71 of Maps at pages 28 and 29, Records of Santa Clara County, California, and being more particularly described as follows: "BEGINNING at a point in the northwesterly line of Welburn Avenue as shown on said map, distant thereon S.70cW. 52.14 feet from the intersection thereof with the southwesterly line of Doris Court, and running thence along the southerly line of Lots 63 and 64 along a curve to the right with a radius of 100.00 feet and a central angle of 20045', for a distance of o 36.22 feet; thence N.89 15'W. 120.69 feet; thence along a curve to the right with a radius of 20.00 feet and a central angle of 77000', for a distance of 23.39 feet to a point in the northeasterly line of Wayland Lane; thence along a projection of the northeasterly line of Wayland Lane as shown on said map S.22015'E. 42.99 feet; thence along a curve to the left with a radius of 20.00 feet and a central angle of 92015', for a distance of 32.20 feet to a point in the projected southeasterly line of Welburn Avenue as shown on said map; thence along said southeasterly line N.700E. 137.76 feet to the point of beginning." , J - 1 ~ WHEREAS, at the time of the dedication of said portion of Welburn Avenue, it was intended to extend said avenue on an offset but instead Welburn Avenue has been extended on a straight line west beyond the premises hereinbefore described intended to be a portion of said avenue, and said premises are no longer a part of Welburn Avenue or required for public purposes by the city of Gilroy; NOW $ THEREFORE, BE IT RESOLVED: That the Council of the City of Gilroy does hereby declare its intention to vacate the said portion of Wayland Lane, a public street in the City of Gilroy, hereinabove described, and be it further resolved that this resolution shall be published and said portion of said street above described be posted as required in the street Vacation Act of 1941, under which this proceeding is instituted, and the 19thday of November, 1962, at 8 01 clock P.M. at the Council Chambers in the City Hall, No. 10 South Rosanna Street in the City of Gilroy, County of Santa Clara, State of California shall be and is hereby designated as the time and place at which said Council shall hear any and all persons interested in or who may object to the proposed vacation, and that one publication of this resolution shall be made in the Gilroy Evening Dispatch, a newspaper published in the City of Gilroy, at a date at least ten (10) days prior to the said time of hear ing .
